129 att which said Next Court to witt the Nineteenth Day of June Ann Dom One thousand Seven hundred and thirty three Came Again as well the afd James Lindow as the aforesaid Robert Deniston by their attorneys afd and whereupon the same Robert prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same Day is Given to the afd James here also &a Att which said next Court to witt the twenty first Day of August Ann Dom One thousand Seven hundred and thirty three Came again as well the afd James Lindow as the afd Robert Deniston by their attorneys afd and whereupon the said Robert prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same Day is Given to ^the^ afd James here also &a Att which said Next Court to witt the twentieth Day of November Ann Dom One thousand Seven hundred and thirty three Came again as well the afd James Lindow as the afd Robert Deniston by their attorneys afd and whereupon the said Robert prays further Leave thereof to Imparle hereuntill Next Court and he hath it and the Same Day is given to the afd James here also &a Att which Said Next Court to witt the Nineteenth Day of March Ann Dom One thousand seven hundred and thirty three Came again ^as well^ the afd James Lindow as the afd Robert Deniston by their attorneys afd and whereupon the said Robert as before Defends the force and Injury when &a and saith that he Did not assume upon himself in Manner and form as the said James above against him hath Complained & thereof he puts himself upon the Countrey &a And the plft in Like manner Thereupon it is Commaned the Sherriffe of Somerset County that Immediately he Should Cause to Come here before the Justices of his Lordships County Court of Somerset now in Court Setting at Dividing Creek in the County afd Twelve &a by whom &a and who neither &a to Recognize &a because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurrors of that Same Jury by Joshua Caldwell Gent sherriffe of the County afd to this Impannelled being Called Came to witt Edward Beauchamp Parker Selby George Tull Littleton Townsend Robert Mitchell Jos.a Sturgis George Benston William Mills Thomas Ryley William Holland John Fleming Thomas Dixon who to say the truth of the premisses being duely Elected tryed and Sworn upon their Oath did say that the afd Robert Denniston did not assume upon himselfe in manner and form as the afd James Lindow above against him hath Complained &a Therefore it is Considered by the Court here that the afd James Lindow take nothing by his writt and declaration afd but be in mercy for his falce Clamour and that the said Robert Denniston go thereof without day &a and further it is Considered that the afd Robert Denniston Recover against the afd James Lindow five hundred & Seventy Two 572 pounds of tobacco for his Costs and Charges by him about his defence in that part sustained to the same Robert by the Court here according to the form of the Statute in Such Case Lately made and provided adjudged and that the same deft have thereof Execution &a |
