129 altho' Solemnly Called Comes not nor is his writt Aforesaid further prosecuted against the said Humpry Chapman Therefore it is Considered by the Court here that the afd Charles Veazey take nothing by his writt and declaration afd but that he and his pledges of prosecuting to witt John Doe and Rich.d Roe be in mercy and that the afd Humphry Goe thereof without day &a and further it is Considered that the afd Humphry Recover against the afd Charles One thousand and four 1004 pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Humphry by the Court here according to the form of the Statute in Such Case Lately made and provided adjudged and that the same deft have thereof Execution &a
Complains that whereas the said Robert the fifth Day of Febry Ann Dom seventeen Hundred & thirty two at Somerset County afd within the Jur of this Court had Accounted together with the said James of sundry sums of Money by the sd Robert to the sd James before that time Due Owing & Unpaid and upon that Acc.t the s.d Robert was found in arrear to him the sd James in the sum of four pounds Eight shillings & tenn pence Curr.t Money of Maryland and being so thereof Indepted the sd Robert in Consideration thereof the Day & Year aforesd at the place afsd upon himself did assume and to the s.d James then & there Did faithfully promisse that he the s.d Robert the s.d four pounds Eight Shillings & Tenn pence to the sd James when he should be thereunto requ^e^sted he he would ^well^ and faithfully pay and Content Nevertheless the s.d Robert his promise & assumption afd in forme afd made Nothing regarding but plotting & fraudulently Intending the s.d James in that part Craftilly & Subtilly to Deceive and Defraud the sd four pounds Eight shillings & Tenn pence to the sd James altho' the same to Do the s.d Robert by the said James on the afd Fifth Day of Feb.ry in the Year aforesd & often afterwards at Somrst County aforesd he was thereunto requested hath not paid or Contented but the same to him hitherto to pay or Content hath refused and still Doth refuse and Deny To the Damage of the s.d James of Eight pounds seventeen shillings & Eight pence Currt money of Maryland and thereupon he brings suite &a Pledges &a John Doe & R Roe And the said Robert Deniston by William Beckingham his Attorney Cometh and Defendeth the force and Injury when &a and prayeth Leave ^thereof^ to Imparle hereuntill Next Court and he hath it and the same Day is Given to the afd James here also &a (Att |
