128 Intending the said Charles in that part Craftilly and Subtilly to deceive and defraud hath not gott Loggs and made up One mojety or halfe part of the Orchard Fence afd yearly and Every year and kept the Same in good repair during the time afd nor hath he the said Humphry broke up and dugg one full mojety or halfe part of the ground belonging to the said orchard altho' the same to do the said Humphry by the said Charles in the tenth day of December anno Dom seventeen hundred and thirty two and often afterwards at Somerset County afd by the afd Charles he was thereunto requested but the same hitherto to do hath refused and still doth refuse and deny to the damage of the same Charles of twenty pounds Curr.t of Maryland and thereupon he brings suit &a pledges &a Jno Doe & R Roe And the said Humphry Chapman by George Douglas his attorney Cometh and defendeth the force and Injury when &a and prayeth Leave to Imparle here untill next Court and he hath it and the same day is given to the afd Charles here also &a Att which said next Court to witt the ninteenth day of June anno Dom One thousand seven hundred and thirty three Came againe as well the afd Charles Veazey as the afd Humphry Chapman by their attorneys afd And whereupon the same Humphry prays further Leave thereof to Imparle here untill next Court and he hath it and the same day is Given to the afd Charles here also &a Att Which said next Court to witt the twenty first day of August Anno Dom One thousand Seven hundred and thirty three Came againe as well the afd Charles Veazey as the afd Humphry Chapman by their attorney afd and whereupon the said Humphry prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Charles here also &a Att which said next Court to witt the twentieth day of August anno Dom One thousand seven hundred and thirty three Came againe as well the afd Charles Veazey as the afd Humphry Chapman by their attorneys afd and whereupon the said Ch Humphry prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is Given to the afd Charles here also &a Att which said Next Court to witt the ninteenth day of March anno Dom One thousand seven hundred & thirty three Came againe as well the afd Charles Veazey as the afd Humphry Chapman by their attorneys afd and Whereupon the said Humphry as before defends the force and Injury when &a and Says that he did not assume upon himselfe in manner and form as the said Charles above against him hath Complained and of this he putts himselfe upon the Country and the plft likewise Thereupon it is Commanded the sherriff of Somerset County that Immediately he should Cause to come here before the Justices of his Lordship County Court of Somerset now ^in Court^ sitting at dividing Creek in the County afd Twelve &a by whom &a and who neither &a to Recognize &a because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that same Jury by Joshua Caldwell Gent sherriffe of the County afd to this Impannelled being Called Came to witt Edward Beachamp Parker Selby George Tull Littleton Townsend Robert Mitchell Joshua Sturges George Benston Wm Mills, Thomas Bayley Wm Holland John Fleming and Thomas Dixon who to say the truth of the premisses being Elected tryed & Sworn and from the barr of Indmt Concerning of their Verdict of and upon the premisses to render amongst themselves to Commence did recede and afterwards to the Same Barr for their Verdict in that part to render did return upon which the afd plft altho |
