125 the said William Turpin the first Day of april in the Year of Our Lord seventeen ^hundred^ & thirty three at Somerset County afd was Indebted unto the same Joshua in the Sum of Fourteen hundred and Sixty pounds of Tobacco for the Secureing Imprisoning and Nourishing Honor Haley the Servant Woman of the Same Wm Turpin One hundred and sixteen Days at his Especial Instance & Request as by a particular Account thereof herewith into Court brought may appear and so thereof being Indebted the same Wm Turpin the Day and Year af.d at the County afd in Consideration thereof upon himself assumed and to the Same Joshua then & there faithfully promised that he ^the^ same Wm Turpin the Same Fourteen hundred & Sixty pounds of Tobacco to the same Joshua when thereof afterwards he should be required well & truly would pay & Content Nevertheless the afd Wm Turpin his promise & assumption afd nothing regarding but minding & fraudulently Intending the Same Joshua in that part Craftilly & Subtilly to Deceive & Defraud the Same fourteen hundred & sixty pounds of Tobacco or any part thereof tho' often thereunto perticularly on the first Day of November in the year afd at the County afd requsted to the same Joshua hath not paid or him for the same in any Sort Contented but the same to him to pay or for the same in any sort to Content Altogether refused & still doth refuse to the Damage of the Same Joshua three thousand pounds of Tobacco and thereof he brings suit &a Pledges &a Jno Doe & Rd Roe November 1732 Capt William Turpin D.r ll tobacco To 30 days Imprisonment of your Servant maid Honour Haley @ 20 P Day is 600 To 86 days Do @ 10 P Day is 860 Aprill the 1.st 1733 Errors Excepted P me Js.o Caldwell sher 1460 A Copy of the foregoing declaration was made and Sent to be Served on the defend.t according to act of assembly in such Case made and provided Att which said third tuesday of march to witt the ninteenth day of the same month anno Dom One thousand seven hundred & thirty three being the day of the Return of the same Writt Cometh the said Joshua Caldwell by his attorney afd and the Coroners of Somerset County to whom the foregoing writt was directed Likewise Came and made return thereof in these words following vizt Cepi Corpus declaration in time P W.m Lane Coroner Whereupon the said William Turpin by Francis Allen his attorney Comes and defends the force and Injury when &a and Saith that he did not assume upon himselfe in such manner and form as the afd Joshua above against him hath Complained and of this he doth put himselfe upon the Country &a and the Plantiffe in Like manner Thereupon it is Commanded the Corroners of Somerset County that Immediately they should Cause to Come here before the Justices of his Lordships County Court of Somerset now held at dividing Creek in & for the County afd Twelve &a by whom &a and who neither &a to recognize &a because as well &a and afterward) |
