125 afterwards Immediatly Came thereof the Jury &a and the Jurors of that ^same^ Jury ^by^ William Lane and Henry Ballard Gentlemen Corroners of the County afd to this Impannelled being Called Came to witt Edward Beachamp Thomas Dixon George Benston, Robert Collier Neal MccClester Parker Selby Samuel Dorman George Tull W.m Holland Joshua Sturges Robert Mitchell and John Fleming who to say the truth of and upon the premisses being Elected tryed and Sworn upon their Oath did say that the afd William Turpin did assume upon himselfe in manner and form as the afd Joshua Caldwell above against him hath Complained and ^they^ assessed the damages of the Same Joshua by Occasion of the non performance of the promise and assumption afd further than his Costs and Charges by him about his Suit in that part apposed to Six hundred & One pounds of tobacco and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the afd Joshua Caldwell recover against the afd William Turpin his damages afd by the Jurors afd in form afd assessed as also seven hundred & seven 707 pounds of tobacco for his Costs and Charges afd to the same Joshua by the Court hereof his assent of Increase adjudged which Certain damages in the whole do amount to pounds of tobacco and the afd William in mercy &a
Same County the third Tuesday of March then Next to Answer unto Thomas Gray of a plea of trespass upon the Case &a and that thereof he should not fail &a And the said Thomas Gray by Francis Allen his attorney Complains against the afd Richard Phillips in the plea afd as followeth Viz.t Somerset County ss.t Richard Phillips Late of Somerset County planter was Attached to Answer unto Thomas Gray of a plea of Trespass upon the Case &a And whereupon the said Thomas by Francis Allen his attorney Complains that whereas the said Richard after the first day of may Ann Dom seventeen hundred & five to wit on the Thirteenth Day of August Ann Dom seventeen hundred & thirty Two at Somerset County afd within the Jurisdiction of this Court made his Certain note in Writing Called a Promissory Note with his Proper hand subscribed bearing Date the same Day & Year last mentioned and the said Note to him the said Thomas then & there Delivered by which said Note the said Richard did Oblidge himself to pay or Cause to be paid unto the said Thomas or his Order the Sum of Nine pounds and four pence to be paid in pork and staves by the first Day of February next Ensuing the Date of the s.d Note Merchantable and by reason thereof as also by force of the satute in that Case Lately made & Provided the said Richard became Chargeable to pay to the said Thomas the afd sum of Money According to the Tennor of the Note afd and so being Chargeable the afd Richard in Consideration thereof afterwards to witt the aforesd thirteenth Day of (August) |
