1733 115 billa vera Samuel Wilson foreman Thereupon Command was given to the sheriff of Somerset County that he should take the said Elias Taylor if &a to answer &a and afterwards to witt the ninteenth day of march Anno Dom One thousand Seven hundred and thirty three before the Justices of his Lordships the Lord proprietary's County Court of Somerset now held at dividing Creek in and for the County afd Cometh the afd Elias Taylor in his proper person according to a Certain Recognizance by him and his Securitys in that part first acknowledged and had a hearing of the Indictment afd and says that of the premisses afd above upon him Imposed he is guilty thereof and is willing to pay his fine for the fact afd &a Whereupon all and Singular the premisses by the Court here being seen heard and fully understood It is Considered that the afd Elias Taylor pay to his Lordship the Lord proprietary six hundred pounds of tobacco (to the use of somerset County) for his fine for and by Occasion of the premisses afd whereof in form afd he is Convict and that the same Elias Taylor be taken to satisfie his said Lordship of the fine afd Whereupon the said Elias Taylor ^is ordered to^ give security for the payment of the fine afd and the Severall Officers Fees due by Occasion of the premisses afd thereupon a Certain Thomas Prior present herein Court in his proper person undertook for the said Elias Taylor for to pay the fine afd and the Severall Officers Fees due as afores.d Likewise the said Elias Taylor is ordered to give Security for to save and keep harmless as well the Justices of Somerset County Court and their Successors for the time being as also the Inhabitants of the said County from all Costs Charges and troubles by reason of the birth maintainance nourishing and bringing up of a bastard Child Lately begott by him the said Elias Taylor of a Certain Rachel Braton &a Whereupon the said Elias Taylor with Thomas Prior his security both present here in Court acknowledged themselves to be Indebted unto his Lordship the Lord proprietary in the sum of Twenty pounds Sterling good and Lawfull money of England of their Severall goods and Chattles Lands and tenements to be made and Levied to the use of Somerset County If it happen that the said Elias Taylor do not from time to time and at all times hereafter acquitt discharge and Save harmless as well the Justices of Somerset County Court afd and their successors for time being as also the Inhabitants of the Same County of and from all Costs Charges and troubles whatsoever for or by reason of the birth maintainance Nourishing and bringing up the Child afd and of and from al suits troubles Charges and demands whatsoever touching or Concerning of the same &a
thirty and three at the parish afd in the County afd within the Jurisdiction of this Court Did Commit Fornication with a Certain Elizabeth Townsend and of her body then and there had Carnal Knowledge and a bastard Child on the body of her the same Elizabeth then and there did beget to the high Displeasure of almighty god to the Evill Example of all Others in such Case offending Contrary to the Peace of the said Lord Proprietary that now is his good rule and Government and against the Form of the Act of Assembly in such Case lately made and provided &a Testes Eliza Townsend On |
