114 November in the Year of Our Lord God seventeen hundred thirty and three at the parish afd in the County afd within the Jurisdiction of this Court did Committ fornication with a Certain Mary Townsend and of her body then and there had Carnall Knowledge and a bastard Child on the body of the same Mary then and there did begett to the high displeasure of Almighty God to the Evill Example of all others in such Case Offending contrary to the peace of the said Lord proprietary that now is his good rule and Government against the form of the act of assembly in Such Case lately made and provided &.a Test Mary Townsends On the Backside of the foregoing Bill of Indictment it thus Endorsed viz.t Jn Purnall foreman Thereupon Command was given to the sherriffe of Somerset County that he should take said Stephen Winwright if &.a to answer &.a and now hereat this day to witt the ninteenth d of march One thousand Seven hundred and thirty three before the Justices of his Lordships County Court of Somerset now held at dividing Creek in and for the same County Came the afd Stephen Winwright in his proper person and being by the sheriff set to the Barr is thereupon Instantly demanded how he would acquitt himselfe of the premisses afd above upon him Imposed says that of the premisses afd above upon him Imposed he is Guilty thereof and is willing to pay his fine for the fact afd whereupon all and Singular the premisses by the Court here seen heard and fully understood and Mature deliberation thereupon had It is Considered by the Justices here that the afd Stephen Winwright pay to his Lordship the Lord proprietary (for the Use of the County afd) thirty shillings Currant money for his fine by Occasion of the premisses above upon him Imposed and that the same Stephen Winwright be taken to Satisfie his Said Lordship of the fine afd thereupon the said Stephen Winwright is ordered to give Security for the payment of the Severall Officers fees due by occasion of the premisses afd Whereupon John Dennis Jun.r present herein Court undertook for the said Stephen Winwright for to pay the Severall Officers fees due as afd &.a Likewise the said Stephen Winwright is ordered to give Security for to save and keep harmless as well the Justices of Somerset County Court and their Successors for the time being as also the Inhabitants of the said County from all Costs Charges and troubles by reason of the birth maintainance nourishment & bringing up of a bastard Child Lately begott as afd on the body of the afd Mary Townsend &.a Whereupon the said Stephen Winwright with John Fleming and John MeCuddy of the County afd Gent all present herein Court in their proper persons acknowledged themselves Indebted unto his Lordship the Lord proprietary In twenty pounds Sterling good and Lawfull mony of England of their Severall goods and Chattells Lands and tenements Joyntly and Seperately to be made and Levied to the Use of the County of Somerset afd If it Happen that the said Stephen Winwright do not from time to time and at all times hereafter acquitt discharg and save harmless as well the Justices of Somerset County County Court afd and their Successors for the time being as also the Inhabitants of |
