112 I do here by Certifie that Woney MccClammey was Qualified as Constable of Manocan hundred by taking of the Severall Oaths appointed by act of assembly and signing the Oath of abjuration & Making and subscribing the test on the twelfth day of december anno Dom 1733 before Henry Ballard
did Committ fornication with a Certain person to the Jurors afd unknown and did permitt the Same unknown person then and there to have Carnall knowledge of her body and to begett then and there a bastard Child on the body of her the same Mary to the high displeasure of Almighty God to the Evill example of all Others in Such Cases offending Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the act of assembly in such Case Lately made and provided &.a Test Mitchell Dashiell On the backside of the foregoing bill of Indictment it was thus Endorsed viz.t Billa vera John Purnall foreman Thereupon it was Commanded the sher of Somerset County that he should take the said Mary Maguire if &.a to answer &.a and now hereafterwards to witt the ninteenth day of March one thousand seven hundred and thirty three before the Justices of his Lordships County Court of Somerset now held at dividing Creek in and for the County afd Came the afd Mary Maguire in her proper person and being by the Sher set to the barr is thereupon Instantly demanded how she would acquitt herselfe of the premisses afd above upon her Imposed says that of the premisses afd above upon her Imposed she is Guilty thereof and makes Oath that a Certain John Hopkins Jun.r is the begetter of the Child that she stands Indicted for but hath not wherewithall to pay her fine for the fact afd &.a Wherefore it is Considered by the Justices here that the afd Mary Maguire be whipt with fifteen Lashes at the publick whiping post on the bare Back well Laid on untill the blood appear ^and that she be taken &.a^ thereupon as the Corporall punishment afd Command is given to the sher of Somerset County that he ^should^ do thereof Immediate Execution afterwards in the Same Court Came the Said sheriff and made return that he had done the Execution of the Judgm.t afd by whiping of the same Mary Maguire at the publick whiping post with fifteen Lashes on the bare back well laid on untill the blood did appear as afd he was Commanded whereupon the said Mary Maguire is Ordered to give Security for he appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the County afd the third tuesday of of June next to give Evidence on behalfe of his Lordship against John Hopkins Jun.r &.a Thereupon John McClester of Somerset County Gent present herein Court in his proper person undertakes for the said Mary Maguire and acknowledged himselfe to be Indebted unto his Lordship the Right Honrble the Lord proprietary in five pounds Sterling good and Lawfull money of England of his goods and Chattells Lands and tenements to the Use of his said Lordship his heirs and Successors to be made & Levied If it Happen that the said Mary Maguire do not appear before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of June next and do not then and there give ^such^ Evidence as she knows against the afd John Hopkins Jun.r of and Concerning |
