(11) The same John at his Request by the Court here and Consent of the parties afsd adjudged and the aforesaid William In Mercy &c.a Whereupon the said William West present here in Court in his proper person is at the prayer of the afsd John Purnell by his attorney afs.d Comitted into the Custody of the sher of Somerset County there to Remain untill the said John of his Damages and costs and Charges afsd should be fully satisfyed the said Sher to witt Joshua Caldwell Gent present here in Court took Charge of the said Wm West accordingly &c.a
in the County afd the third tuesday of March then next to answer unto John Hovington of a plea of trespass upon the Case &c.a and that thereof he should not fail &c.a And the afd John Hovington by Francis Allen his attorney Complaines against the said William Gray in the plea afd as followeth viz.t Somerset County ss William Gray Late of Stepney parish in Somerset County planter was attached to answer unto John by Francis Allen his attorney Complaines that whereas the said W.m the first day of February anno Dom one thousand seven hundred and thirty two at Somerset County afd within the Jurisdiction of this Court was Indebted unto the said John in Eighteen hundred pounds of Tob.o and three Shills Curr.t Mony of Maryland for sundrys properly chargeable in Acc.t as by Acc.t hereunto annexed may in Court appear And being so thereof Indebted the Said William in Consideration thereof the day and year aforesaid at the place afores.d upon himself did assume and to the said John then and there did faithfully promise that he the said William the said Eighteen hundred pounds of Tob.o and three Shills Curr.t Mony to the said John when he should be thereunto Requested he would well and faithfully pay and Content Nevertheless the said William his promise and assumption aforesaid In form aforesaid Made Nothing Regarding but plotting and fraudulently Intending the said John in that part Craftilly and Subtilly to Deceive and defraud the said Eighteen hundred pounds of Tob.o and three Shills Curr.t Mony to the said John altho the same to do the said William by the Said John on the aforesaid first day of Feb.ry in the year aforesaid and often afterwards at Somerset County aforesaid within the Jurr aforesaid he was thereunto Requested hath not paid or to him for the same in any sort Contented but the same to him hitherto to pay or Content |
