(11) Content hath Refused and still doth Refuse and Deny Whereupon the said John saith he is worse and hath Damage to the Value of three thousand six hundred pounds of Tob.o and six Shillings Currt Mony of Maryland And thereupon he brings suite &c.a Jno Doe Pledges Depr of R Roe
Jn.o Scott A Copy of the foregoing Declaration and Acct was made and sent to be served on the aforesaid William Gray with the Writt in the plea aforesaid &c.a Att which said third Tuesday of March to Two being the Day of the Return of the said writt Came the aforesaid John Hovington by his attorney afs.d and the Sher of Somerset County to whome the foregoing Writt was Directed Likewise Came and Made Return thereof to the Court here Endorsed in these words following Vizt Non Est Inventus p Joshua Caldwell sherr Thereupon Command is again given to the sheriffe of Somerset County that he should take the same WIlliam Gray Late of Stepney parish in Somerset County planter if he should be found in his baily wick and him should Safe keep so that he might have his body before the Justices of his Lordships County Court of John Hovington of a plea of trespass upon the Case &c.a and that thereof he Should not fail &c.a Att Att which said third tuesday of June to witt the Ninteenth day of the Same month ann.o Dom One thousand Seven hundred and thirty three being the day of the Return of the Same writt Came the Said John Hovington by his attorney afd and the sherr of Somerset County to whom the foregoing writt was directed Likewise Came & made Return thereof to the Court here Endorsed viz.t Non Est Inventus p Joshua Caldwell sher Whereupon the said John Hovington by his attorney afd prays that for as much as he has Complyed with ye Law in order to an Attachment he may have Judgm.t against the said William Gray for his damages afd by way of attachment according to act of assembly &c.a And for as much as it seems to the Court here that the said John Hovington has Complyed with the Law as alledged &c Therefore it is Considered by the Justices here that the afd John Hovington Recover ag.t the said William Gray the Sum of Eighteen hundred pounds of tobacco and three shillings Currant money his |
