103 the petitions afd and the same petition being read and fully understood and the Court having heard the severall allegations as well on the part of the petitions afd as on the part of the afd John Miller and Maturally Considered the Same &a Wherefore it is Ordered and adjudged by the Court here that the afd John Miller be discharged from the petition afd and the road to remain as it does with any alteration &a Robert Collier Overseer of the roads in stead of Capt John MaClester and to have his Labourers &a Ordered by the Court that the road Leading from the Chapple by Kings Mill on the back of William Turpins Jun.r through the bear Swamp into the Main Road by Mrs Bentons be and remain a County road and that Coll Robert King Mr David Wilson and Isaac Coston Lay out and Streighten the Same Road in such places as they Shall think fitt and that bridges and Causways be made in the Same Road where need full and that the road Leading from Richard Chamber's to Richard Knights be no Longer a County road &a
Justices of his Lordships County Court of Somerset to be held at dividing Creek in the County afd the third tuesday of Novem next to answer unto John Dennis Jun.r of a plea of trespass upon the Case &a and that thereof he should not fail &a And the afd John Dennis Jun.r by Francis Allen his attorney Complained against the afd Samuel McCall John Blackbourn and John Allen in the plea afd as followeth Vizt And Whereupon the Said John Dennis by Francis Allen his Attorney Complains that Whereas the sd Samuel MccCall John Blackburn and John Allen the first day of September Anno Dom seventeen hundred and thirty three at Somerset County aforesd within the Jurisdiction of this Court were Indebted unto the Said John Dennis in fifty shillings and six pence Curr.t Mony of Maryland for sundrys which are properly Chargeable in Acct as by Acc.t hereunto Annexed may in Court appear and being so thereof Indebted the sd Defd.ts in Consideration thereof upon them selves did assume and to the sd John Dennis the day and year aforesd at the place aforesd did faithfully promisse that they the sd Defd.ts the sd Fifty Shillings & Six pence to the Said John Dennis when they should be thereunto requsted they would (well |
