98 Requested hath not paid or two hum for the same in nay sort Contented by the same to him hetherto to pay or in any sort for the same to content hath Refused and still doth refuse and Deny whereupon he saith he is wores and hath Damage to the Value of three pounds fourteen shillings and thereupon he brings suit &.c F Allen P Qrte Pledges de 8 J Doe R Roe
and as to the Damage of the same Hutton by him by occasion of the premisses in that part sustained the same John says and Confesseth that the afd Hutton hath Sustained damages by occasion of the premisses further then His costs and Charges by him about his Suit in that part apposed to one pound Seventeen Shillings Currant Money of Maryland and not more and because the afd Hutton Denys not this but the same Allegation Confesseth to be true prays Jugment and Those Damages above confessed together with is costs and Charges afd to him adjudged &.c Therefore by consent of the parties afd it is considered that the afd Hutton Hill Recovere against the afd William Dulany his Damages afd to one pound Seventeen Shillings Currant Money by the same W.m 245 in form afd Confessed as also two hundred & forty five pounds of 245 Tobacco for his costs and Charges afd to the same Hutton at his Request by the Court here and consent of the parties afd adjudgd w.ch Damages in the whole do ammount to one pound Seventeen Shillings and four pence and Two hundred & forty five pounds of tobacco and the afd deft in mercy &c Whereupon the aforesaid William Dulany being Called appears and thereupon the Said William Dulany at the pray of the afd Hutton Hill by his attorney is adjudged to Give Speciall bail to the action aforesaid thereupon a Certain John Evans Sen.r of Somerset County planter undertakes for the Said William Dulany that if in Case the Said Hutton Hill Shall recover Judgmt in the plea afd against the Said William Dulany or that the Said William Dulany Should be therein Convict that then he the Said William Dulany Shall pay the Condemnation of the Court thereupon or render his body to the the Custody of the Sher of Somerset County in Satisfaction thereof or that he the Said John Evans will do the Same for him memorand.m this bail peice Should have been entered before the Confession but was Omitted and Entered here &c This day to witt the 12 day of Aprill in 1731 we the Subscribers being qualified according to Law did enter into the Lands of a Certain Sarah Kirke together with Maj.r William Planner and ^then &^ there did view the plantation houses and Out houses fences and Orchards and find them as followeth vizt to One hundred and Fifty Nine pannells of old fence round forty Seven apple trees to two hundred and Seventy eight pannells of Very Old fence round the houses and 21 apple trees to one old dwelling house 25 foot Long to one old milk house 15 foot long to old barn 40 foot long to two hundred and fifty five pannells of old fence Rownd a place Called Little Essex and ten apple trees within the said fence Given Under our hands ye day & year above Thomas Williams (seal) I do hereby Certifie yt the Subscribers Thomas Williams & Thomas Dixon were qualified Thomas Dixon (seal) before me one of his Lordships Justices of ye peace for this County of Somrset according to law Jno Scott |
