96 and thirty Six pounds of tobacco to the Same William by the Court here of his assent adjudged and the afd defendt in mercy &c whereupon the Said Robert Houstone by his attorney afd prays that he may have a hearing in Equity on the afd verdict and Judgm.t Rendered against ^him^ on the part of the afd William Holland which if Granted he Giving Security according to act of assembly in Such Case made and provided Whereupon the afd Robert Houstone ^present here in Court^ Gave Security for the due prosecution of a writt of Injunction according to the form following viz.t Know all men by these presents that wee Rob.t Houstone John Townsend Jun.r and Bruffe Broughton all of Somerset County planters are held and firmly bound unto William Holland of the same county Planter in the full and Just sum of two hundred pounds Good and lawfull money of Maryland and two thousand and seventy two pounds of Good sound Merchantable Leaf Tobacco in cash ^to^ contain the same to be paid to the said W.m Holland his Executors adm.rs or assignes to the true payment Whereof we bind ourselves and Every of us our and Every of our heirs Ex.rs and Adm.rs Joyntly and Severally for and in the whole firmly by these psents sealed with our seals and Dated this 18.th day of June Ann Dom 1731 Whereas the above ^bound^ Robert Houston ^hath obtained^ an Injunction to stay proceeding at Law on a Judgment Rendered against him in Somerset County Court by William Holland for One hundred pounds of Good and Lawfull money of the afd County and One thousand and thirty Six pounds of tobacco Costs of Suit Now the Condition of the above Obligation is Such that if the said Robert Houstone Shall prosecute the Said Writt of Injunction with Effect and Satisfie and pay as well the said One hundred pounds of Good and Lawfull money of the afd County as all Costs damages and Charge that Shall accrew in the Chancery Court or be Occasioned by the delay of execution of the Said Judgm.t unless the Court of Chancery Shall deem to the Contrary and Shall in all things Obey Such Order and decree as the Chancery Court Shall make in the premisses then the above Obligation to be Void and of None Effect Els to be in full force and vertue his Sealed and delivered in Psence of us Robert R Houstone (Seal) Francis Allen marke Jno Sheldon John Townsend (Seal) Bruff Broughton
hundred and thirty at somerset county afd and within the Jur of this court was Indebted unto him the said John Murray in five pounds Eight Shillings and three pence currant Money for sundry goods wares and Marchandizes by the said John Murray at the Especial Instance and Request of him the said John Harper sold credited and Delivered as by an Acco.t thereof here unto annexed in court may appear and being thereof so Indebted he the said John Harper in consideration thereof the day and year afd at the County afd upon himself did assume and unto the said John Murray then and there (did) |
