June Court       1731                    96

did faithfully promise that he the said John Harper the said five pounds Eight
shillings and three pence to the said John Murray when thereunto afterwards
he should be Requested well and faithfully would pay and content  Nevertheless
the said John Harper his promise and Assumption afd in forme afd made
not minding or Regarding but plotting and fraudulently and Intending the
said John Murray in that behalf craftilly and Subtilly to Deceive and Defraud
the said five pounds Eight Shillings and three pence to the said John Murray
hath not paid or in any wise contented Altho so to do he the said John
Harper afterwards to witt the same day and year afd in the county afd
and often afterwards by him the said John Murray was thereunto Requested
but the same to him the said John Murray to pay and content he the said
John Harper hitherto  Altogether hath Refused and Denyed and Still doth refuse
and Deny Whereupon he the said Murray saith that he is made worse and
hath Damages to the value of ten pounds Sixteen Shill.s and Six pence curr.t

                                  Att which Said Next Court to witt the Sixteenth day of March anno Dom One thousand
Seven hundred and thirty Came again as well the afd John Murray by his attorney afd as the afd John Harper by
In his Own proper person as afd and whereupon the Said John Harper prays further Leave thereof to
Imparle here untill the next Court and he hath it and the Same day is Given to the afd plft here also

       Att which Said next Court to witt the fifteenth day of June anno Dom One thousand Seven hundred
and thirty One Came againe as well the afd John Murray by his attorney afd and whereupon the afd John Harper
puts in his place William Beckingham attorney at Law to defend the action afd against the afd John
Murray in the plea afd   And whereupon the Said John Harper by his attorney defends the force and Injury
when &.c and Says that he did not assume upon himselfe in manner and form as the afd John Murray
above against him hath Complained and of this he putts himselfe upon the Country and the afd plft
in Like manner
                                              Thereupon Command was Given to the Sher of Somerset County that Immediately
he Cause to Come here twelve &.c by whom &.c who neither &.c to Recognize &.c because as well &.c of
which Said preceipt he was Commanded and now hereafterwards to witt the same day and Year Came as well the afd Plft
as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise
