1731 95 Houston the first day of Aprill one thousand ^seven^ six hundred and twenty Nine at somerset county within the Jur of this court by his certain writting obligatory Granted himselfe to be holden and firmly bound unto the same William Holland in the afd full and Just sum of one hundred pounds of Good and Lawfull money of the afd county to be paid the same W.m by or upon the first day of Aprill In the year one thousand seven hundred and thirty yet the afd Robert altho often thereto Required the afd sum of one hundred pounds of good and Lawfull money of the afd County to the same W.m hath not Rendered but the said Robert the same hitherto to the same W.m Holland to Render hath altogether Denyed and still doth Deny whereby the same W.m says he is worse and hath Damage to the Value of one hundred pounds currant Money and thereof he brings ^this Suit and the Same William brings^ hereinto court the Writing obligatory afd with the Deb.t afd in forme afd Wittnesseth &.c Levin Gale P Quer pledges &c J Doe R Roe And the afd Robert Houston by Francis Allen his attorney Cometh and defendeth the force and Injury when &c and prayed Leave thereof to Imparle here untill the next Court and he hath it and the Same day is Given to the afd William here also &.c Att which Said next Court to witt the Eighteenth day of August ann.o Dom One thousand Seven hundred and thirty Came againe as well the afd WIlliam as the afd Robert by their attorneys afd and whereupon the Said Robert prays further Leave ^thereof^ to Imparle here untill the next Court and he hath it and the Same day is Given to the afd William here also &c Att which Said next Court to witt the fifteenth day of June ann Dom One thousand Seven hundred & thirty One Came againe as well the afd William as the afd Robert by their attorneys aforesaid And whereupon the s.d Robert as before defends the force and Injury when &.c and Saith that he of the debt aforesaid by virtue of the writing aforesaid Ought not to be Charged because he Saith that the writing aforesaid is not his deed and of this he putts himselfe upon the Country and the afd plft in Like manner Thereupon Command is Given to the Sher of Somerset County that Immediately he Cause to here twelve &.c by whom &.c who neither &.c to Recognize &.c because as well &.c of which said preceipt the Said Sher to ^witt^ John Purnall Gent Now here at this day to witt the same day and Year Last mentioned Comes and makes Return the afd day and year Came as well the afd William as the afd Robert by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Thomas Humphrys, John Scarbrough Lewis Rigsby Christopher Nutter, Ambross, Willett, Charles Townsend, John Bevins, John Owten John Huet Nutter, Robert Watson William MccClester and James Caldwell who being duely Elected tryed and Sworn to Say the truth ^in^ of the premisses upon their Oath do Say that the writing Obligatory afd is the deed of him the Same Robert as the afd W.m above against ^him^ hath declared &.c Therefore it is Considered that the aforesaid William Holland Recover against the aforesaid Robert Houstone his debt aforesaid and his damages by Occasion of the detaining of the Same debt to One thousand and |
