1731 95 Nor any part thereof to the same John hath not paid or him for it in any wise contented Altho the said Thomas afterwards to witt the same day and year afd at the county afd and within the afd Jur was thereto requested by the same John but the said the Thomas the same to doe hath altogether Refused and still doth refuse whereby the same John says he is worse and hath Damage to the Value of forty two pounds sixteen shillings Like money and thereof brings this suite &.c Levin Gale P Qr pleds of Jno Doe R Roe
Justices of the peace for the county of somerset and made oath upon the Evangelist of Almighty God that the above Acco.t is Just and true and that he Never Received any part or percell thereof more than he has given Credit for nor any any security or satisfaction for the same Sworn before me Jno Scott Att which Said third tuesday of June to witt the fifteenth day of the Same month anno Dom One thousand Seven hundred and thirty One being the day of the return of the Said writt Cometh the Said John Murray by his attorney aforesaid and the Sher of Somerset County to whom the foregoeing writt was directed ^likewise^ Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Non est Inventus P John Purnall sher Whereupon the aforesaid John Murray by his attorney afd prays that for as much as he hath Complyed with the Laws in Order to an attachment he may have Judgment against the Said Thomas Euchmarsh and Company by way of attachment for his damages aforesaid according to an act of assembly &c Wherefore for that it seems to the Justices here that the aforesaid John Murray hath Complyed with the Law as alledged &.c Therefore it is Considered by the Justices here that the aforesaid John Murray Recover against the afd Thomas Euchmarsh and Company twenty One pounds and Eight Shillings Currant mony his damages by Occasion of the premisses afd as also all Costs and Charges by the Said plft Laid Out and Expended 319 by way of attachment against the Goods Chattells Rights or Creditts of the Said Thomas Euchmarsh and Company according to act of assembly in Such Case made and provided &c
And whereupon the Same William Holland by Levin Gale his attorney Saith that whereas the afd Robert Houstone |
