93 of Tobacco and Eighteen Shillings and Six pence currant Money as afd residue of the aforesaid five hundred Seventy Six pounds of Tobacco and Eighteen Shillings and Six pence currant money as afd ^to^ the said James his promise and assumption afd in forme afd made nothing regarding but plotting and fraudulently Intending the said James in that part Craftilly and Subtilly to Deceive and Defraud the said three hundred senty four pounds of Tobacco and Eighteen Shillings and Six pence currant money afd to the said James altho the same to do the said Robert by the said James the first day of Aprill Ann Seventeen hundred hundred and thirty one at somerset County afd within the Jur afd was thereunto requested hath not paid or contented but the same to the said James hitherto to pay or content hath refused and still doth refuse and Deny to to the damage of him the said James Six pounds like money as afd and thereup he brings suit &.c Levin Gale P Qur pledg pr Jno Doe R Roe
And the aforesaid Robert Bevill in his Own proper person Comes and defends the force and Injury when &c and Says that he Cannot Gainsay the action afd of the afd James Shirley nor but that he did assume upon himselfe in manner and form as the afd James above against him hath Complained and as to the damage of the Same damage of the Same James by him by Occasion of the premisses in that part Sustained the Same Robert Says and Confesseth that the afd James has Sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to five hundred and fifty pounds of tobacco and not more and because the afd James denys not this but the Same allegation Confesseth to be true prays Judgmt and those damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties afd it is Considered that the afd James Shirly Recover against the afd Robert Bevill his damages afd to five hundred and fifty pounds of tobacco by the Same Robert in 213 form afd Confessed as also two hundred and thirteen pounds of tobacco for his Costs and Charges afd to the Same James at his Request by the Court hereof his assent adjudged & ye afd deft in mercy &c
the third tuesday of June then next to answer unto Amos woodward of a plea that he render unto him forty One pounds Seven Shillings and Six pence Currant mony which to him he Owes and Unjustly detaines &c And the Said Amos Woodward by James Shirley his attorney declared against the afd John Doneslson in the plea afd |
