1731 92 presents of the complainent or Def.t if any touching the truth or rembrances of that of their knowledge or any thing that may relate to the cause afd and that reducing the severall depositions into writting you send the same with this Our Commission from under your hand to us to our County Court of somerset with all Convenient speed Wittness W.m Planner Gent.m one of our Justices of our said Co.t the twenty forth day of November in the Sixteenth Year of our Dominion &c Ann Dom one thousand seven hundred and thirty On the back side of the Foregoeing Commission it was thus Endorsed viz.t may 22.d 1731 before me John Handy One of his Lordships Justices of the peace for Somerset County the within Mamed Thomas Gillis John Disharoon Charles Roach and Benja Fookks and was Sworn on the Holy Evangelist of almighty God to Execute the within Commission according to an act of assembly in Such Case made and provided John Handy Likewise to the Same Commission it was Annexed as followeth vizt We the Subscribers do Certifie that in Complyance to a Commission to us directed bearing date the 24th day of November 1730 Impowering us to Examine Evidences in relation to the bounds of a tract of Land called woodland belonging to John Magloghlin that on the 22d day of may 1731 we did meat on the Land afd to Execute the Same Commission publick Notice being before given according to act of assembly Thomas Gillis John Disharoone, Charles Roach, Benja Fookks Henry Toadvine aged forty Seven Years or thereabouts being Sworn upon the holy Evangelist of Almighty God deposeth and Saith that about thirty or thirty odd years agoe he this deponant was in the woods with his father Nicholas Toadvine on a ridge where the deponant now is and that his father said there is woods Bounder but this deponant do's not remember that he saw nay three nor Exactly the place only that it was on the ridge which Ridge is nigh James Chadwicks House to the Southward of the Said James Chadwicks Cornfeild and further saith not Sworn to before us may 24th 1731 Tho.s Gillis John Disharoone Charles Roach, Benj.a Fooks
that whereas the said Rob.t the tenth day of march seventeen hundred and thirty at somerset County afd within the Jur of this court was Indebted unto him the said James in five hundred Seventy Six pounds of Tobacco and Eighteen Shillings Six pence Current Silver money of this Province by the said James for the said Rob.t at his the said Rob.t Especiall Instance and Request before that time Credited and for his use deposited and paid as by account hereunto annexed may in court appear and being thereof so Indebted the said Robert in consideration thereof the day and year afd at the county and Jur afd upon him self did assume and so the said James then and there did faithfully promise that he the said Robert the said five hundred Seventy Six pounds of Tobacco and Eighteen Shills and Six pence Currant money as afd when he Should be thereunto requested would well and faithfully pay and Content and altho the said Robert one pound three pence part payment of the said five hundred seventy six pounds of Tobacco and Eighteen shillings and six Currant Money as afd to the said James he hath since paid and satisfied yet as to three hundred seventy four pounds (of) |
