           June Court         1731                 91

the said Brent Nuttall Shall be therein Convict that then he the Said Brent Nuttall Shall pay the Condemnation of
the Court thereupon or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that
he the Said William Gray will do it for him &c

       Whereupon the Said Brent Nuttall by Francis Allen his attorney comes and defends the force and Injury when
&.c and Says that he Cannot Gainsay the action afd of the afd John Wootten nor but that he did assume upon himselfe
in manner and form as the afd John above against him hath Complained and as to the damage of the Same John by
him by Occasion of the premisses in that part Sustained the Same Brent Saith and Confesseth that the afd John has
Sustained damages by Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part
apposed too five pounds and Eleven pence farthing Currant mony and not more and because the afd Brent denys
not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with
those Costs and Charges aforesaid to him adjudged &c

                   Therefore it is Considered by Consent of the parties aforesaid that the afd John Wootten Recover against
the Said Bent Nuttall his damages afd to the afd five pounds and Eleven pence farthing by the Same Brent Nuttall in
264   form afd Confessed as also two hundred & Sixty Four                                       pounds of tobacco for his Costs
and Charges afd to the Same John Wootten at his request by the Court here and Consent of the parties afd adjudged and
the afd defend.t in Mercy &c                                       with Stins Ex.n till 15 augt Next

County Gent.m Greeting know ye that we have apointed you or any three or
two of you to be our comissioners to Examine Evidences on behalf of a Certain
Thomas Purnall of the County afd in Relation to the Bounds of four tracts of
Land Lying in the county afd to witt Smiths Choice Unity Chance called and
north Benslitt we therefore require you or any three or two of you at some
time and place as to you or any three or two of you shall seem convenient
you Meet on the afd Land called Smiths Choice Unity Chance and North
Benslitt ^you first^ having Taken your oaths on the Holy Evangelist of Allmighty
God according to Act of Assembly in Such case made and provided and there
cause to come before you or any three or two of you all such Evidences as
Shall be to you or any three or two of you Nominated by the said complainent
of Def.t if any and that you or any three or two of you Examine them
upon their corporall oaths to be by you or any three or two of you administered
on the holy Evangelist of Almighty God in the presents of the complainent
or Def.t if any Touching the truth or Remembrance of their knowledge or
any thing that may relate to the cause afd and that Reduceing the Severall
Depositions into Writing you send the Same together with this our Commission
under your or any three or two of your hands to us to our county
Court of Somerset with all convenient Speed Wittness W.m Planner Gent.m
one of Our Justices of our said Court ye twentieth day of March In the sixteenth
Year of Our Dominion Ann Dom one thousand seven hundred and thirty

On the back side of the Foregoeing Commission it was endorsed and to the Same Commission it was annexed vizt
the within Mr William Lane and Mr Nathaniel Hopkins Swore before me to prosecute the within Commission
this 23.d day of Aprill 1731               Jno Smith
