90 or in any Sort to Content hath refused and Still doth refuse and deny whereupon he Saith he is worse and hath damage to the value of Eight pounds Currant mony of maryland & thereupon he brings this Suite &c Francis Allen P Que pledges de And the Said Joseph MccClester by Frances Levin Gale his attorney Cometh & defendeth the force and Injury when &.c and prayed leave thereof to Imparle hereunto untill the next Court & he had it & the Same day is Given to the plft here also Att which Said next Court to witt the Sixteenth day of June anno Dom One thousand Seven hundred and thirty Came against as well the aforesaid William as the aforesaid Joseph by their attorneys afd and whereupon the afd Joseph prayed further Leave thereof to Imparle here untill the next Court and he had and the same day is Given to the aforesaid plft here also &c Att which Said next Court to witt the Eighteenth day of August anno Dom One thousand Seven hundred and thirty Came againe as well the afd William as the afd Joseph by their attorneys afd and the same attorney of the Same Joseph Says that he is not Informed by the Same Joseph his Clyant of any answer for him the Same Joseph to the afd William to in the plea afd to be Given and nothing Else thereof Says by which the Same William Remaineth against the afd Joseph thereof undefended &c by which the same William his damages by Occasion of the non performance of the promise and assumption aforesaid against the Said Joseph Ought to Recover but because it is unknown to his Lordship's Justices here what damages the Said William hath Sustained by Occasion of the non performance of the promise and assumption afd Command is to the Sher of Somerset County that by the Oath of honest and Lawfull men of his bailywick or County he diligently Enquire what damages the Same William hath Sustained as well by Occasion of the nonperformance of the promise and assumption afd as for his Costs and Charges by him about his suit in that part apposed and the Inquisition which thereupon he takes to his Lordships Justices at dividing Creek the third tuesday of August November next under Your Seall and the Seals of them by whose oath he takes the Same Inquisition he Said together with his Lordships writt thereof to him directed and the Same day is Given to the afd Joseph there alsoe Att which Said third tuesday of November to witt the Seventeenth day of the Same month one thousand seven hundred and thirty Cometh the afd William by his attorney afd and then and there offered himselfe against the aforesaid Joseph in the plea afd and the afd then Sher of the County afd Sends not thereof his writt nor any thing thereof made therefore as before Command was to the Same Sher that by the Oath of honest and Lawfull men of his bailywick or County he diligently Enquire what damages the Same William hath Sustained as well by Occasion of the nonperformance of the promise and assumption afd as for his Costs and Charges by him about his Suit in that part apposed and the Inquisition which thereupon he takes to his Lordship's Justices at dividing Creek the third tuesday of March next under your Seal & the Seals of them by whose Oath he takes the Same Inquisition he send together with his Lordships writt thereof to him directed and the same day is Given to the afd plft there also &c Att which said third tuesday of November to witt the Sixteenth day of the Same month one thousand Seven hundred and thirty Came the Said William by his attorney afd and then and there offered himselfe against the afd Joseph in the plea afd and ye afd then Sher of the County afd Sends not thereof his writt nor any thing there^of^ made therefore as before Command was to the Same Sher that by the Oath of honest and Lawfull men of the ^his^ bailywick or County that he diligently Enquire what damages the same William hath Sustained as well by occasion of the non performance of the promise and assumption afd as for his Costs and Charges by him about his Suit in that apposed and the Inquisition which thereupon he takes to his Lordships Justices at dividing Creek the third tuesday of June next under Your Seal & ye Seals of them by whose Oath he takes the Same Inquisition he send together with his Lordships writt thereof to him directed and the same day is Given to the plft there also &c Att which Said third tuesday of June to witt the fifteenth day of the Same month One thousand Seven hundred & thirty One before his Lordships Justices of the County Court of Somerset at dividing Creek Cometh the afd William by his attorney afd and the Sher viz.t John Purnall Gent Sher of the County afd Returned a Certain Inquisition before him at the Court house at dividing Creek in ye County afd the fourteenth day of June and Year afd by the Oath of honest and Lawfull men of his bailywick or County taken by which it appears that the afd William has Sustained damages by Occasion of the non performance of the promise and assumption afd beyond his Costs |
