the Oath of Honest and Lawfull men of his bailywick or County aforesaid he diligently Enquire what damages the
afd Isaiah has Sustained as well by Occasion of the non performance of the promise and assumption afd as
for his Costs and Charges by him about his Suit in that part apposed and the Inquisition which thereof taken
the Sher make appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek
the third tuesday of June next under his Seal and the Seals of them by whose Oath the Same Inquisition is
taken together with his Lordships writt thereof to him directed and the Same day is Given to the afd Isaiah here
also &c
               Att which Said third tuesday of June to witt the fifteenth day of the Same month One thousand seven
hundred and thirty One before his Lordships Justices of the County Court of Somerset at dividing Creek the
cometh the aforesaid Isaiah Bredall by his attorney aforesaid and the Sher viz.t John Purnell ^Gent^ sher of ye
County aforesaid Retourned a Certain Inquisition before him at the Court house at dividing Creeks in the
county aforesaid the Sixteenth day of June and Year afd by the Oath of honest and Lawfull men of his bailywick
or County taken by which it appears that the afd Isaiah has Sustained damages by Occasion of the nonperformance
of the promise and assumption aforesaid further then his Costs and Charges by him about his Suit in
that part apposed to One pound ten Shillings and Six pence Currant mony and for the Costs and Charges
to                                                                                    and forasmuch as it doth appear to the Court
here that the damages afd by the Inquisition afd appears to be within the Jurisdiction of the Court so that
there Can be noe Other Judgm.t than for a nonsuite &c

       Therefore it is Considered that the afd Isaiah Bredall take nothing by his writt aforesaid but be in mercy for
his falce Clamour and that the afd James Rownd Executor of Robert Ogleby Goe thereof without day &c and
further it is Considered that the afd James Rownd Recover against the afd Isaiah Bredall
                                                    pounds of tobacco for his Costs and Charges by him about his defence in that
part Sustained to the Same James by the Court afd now hereof his assent according to the form of the Statute
in Such Case Lately made and provided adjudged & ^that^ the afd James have thereof Execution &c

Somerset County ss     Joseph Maclester late of Somerset County Gent was attached to answer unto
William Maclemmy of a plea trespass upon the Case &c
And whereupon the Said William by Francis Allen his attorney Complaines that Whereas the
Said Joseph the twentieth day of November anno Dom One thousand Seven hundred and twenty three at Somerset
County afd within the Jurisdiction of this Court was Indebted unto the Said William in five pounds Seven Shillings
and One penny Currant money of maryland as by a Certain note by the Said Joseph Signed dated the day and Year
aforesaid herein Court produced may appear and being so thereof Indebted the Said Joseph in Consideration thereof
the day and year aforesaid at the County afd upon himselfe did assume and to the Said William then and there faithfully
did promise that he the Said Joseph the Said five pounds Seven Shillings and One penny to the said
William when thereunto afterwards he Should be requested he would well and faithfully pay and Content
and altho the Said Joseph One pound three Shillings and two pence three Farthings percell of the afd
five pounds Seven Shillings and One penny to the said William He hath paid and Satisfied Yett as to four
pounds as to four pounds three Shillings and ten pence three Farthings residue thereof the Said Joseph his
promise and assumption afd in form afd made nothing regarding but plotting and fraudulently intending the
Said William in that part Craftilly and Subtilly to deceive and defraud the said four pounds three Shillings and
ten pence farthing the Said William altho' the Same to do the Said Joseph on the first day of October one thousand
seven hundred & twenty six and often afterwards at the County afd by the said William he was thereunto
Requested hath not paid or to him for the Same in any Wise Contented but the same to him hitherto to pay
