if God afflected with Sickness at the house of him the Said Isaiah in Consideration that he the Said Isaiah at the Speciall Instance and request of the Said Isaiah Robert then and there would provide for and nurse the Said Robert in the time of his Sickness and in Case the Said Robert Should depart this Life at the house of him the Said Isaiah he the Said Isaiah would Bury him the Said Robert in a Christian Like ^& decent^ manner the Said Robert then and there in his life to witt the day and year aforesaid at the day and year afd at the place aforesaid upon himselfe did assume and to the Said Isaiah then and there did faithfully promise that the Said Isaiah so much as he the Said Isaiah should reasonably deserve for the nursing of him the Said Robert in the time of his Sickness and for all reasonable damages and Expences about the Same as also for the funerall Charges and Expences in and about the burying of him the Said Robert in Case of death of him the Said Robert Out of the estate of him the Said Robert after the decase of him the Said Robert Should be truely and honestly Contented Satisfyed and paid and the Said Isaiah in fact Saith that Giveing Creditt to the promise and assumption of the Said Robert in his Lifetime so as afd made he the Said Isaiah and family did well and diligently affend the Said Robert in the time of his sickness and also did after the decease of the Said Robert bury the Said Robert in a Christian Like ^&^ deacent manner and that he for the attendance Nursing and trouble of his hous and family and the Spayling of his bed by the Said Robert and for the funerall Charges and Expences in buring the Said Robert doth Reasonably deserve to have and receive of the said James Ex.r of the Said Robert the Sum of Four pounds Eleven Shillings and two pence Curr.t money of maryland of which the Said James Rownd the thirtieth day of march anno Dom Seven hundred & twenty Nine had notice by the hands of the Said Isajah had notice vizt at the County afd within the Jurisdiction afd Nevertheless the Said James the promisse and assumption afd of the aforesaid Robert in his Lifetime so as afd made nothing regarding but plotting and fraudulently Intending the Said Isaiah in that part Craftilly and Subtilly to deceive and defraud the aforesaid four pounds Eleven Shillings and two pence Out of the Estate of the Said Dec.d altho the Same to do the said James by the Said Isajah on the afd thirtieth day of march in the Year Last mentioned and Often afterwards at the County afd he was thereunto requested hath not paid or in any Sort for the Same Contented hath refused and Still doth refuse and deny whereupon the Said Isaiah Saith he is worse and hath damage to the value of nine pounds Currant money of maryland and thereupon he brings Suit &c march 2 1728 Robert Ogleby deceased Dr Fran Allen P Quer Pledgs & Jno Do R Roe
