88 the Magraw the Elder who pointed his hand towards said Point and said on that point stood M.r Whitty uppermost bounder of Colebrook being a white oak from that he the said Magraw had markt it with his one hands near which place then is this day a mulbry post put up markt with four Notches on Each side and further this Deponant saith not Taken before us this 15.th day of may Ann 1731 Rob.t King Tho.s Brown Robert Laws Aged fifty years or there abouts Deposeth on the holy Evangelist of Allmighty God that he this deponant was on a Jury to Enquire into the bounds of a tract or Pcell of Land called Colebrook about twenty four or five years since as Near as he can Remember at which time George Bets now Deceast was product as an Evidence to prove the uppermost bounder of the afd Land called Colebrook who was sworn and also W.m Waller sence decast with George Phebus who is now here present the aforenamed Betts Declared that as he was goeing or passing along the Road opposet to a point where he this deponant now stands near to the Mouth of a glade a Little down goose creek from W.m Jones house where Geo.r Phebus deposeth that he had seen a markt white oak that he had been showd as the upermost bounder of Colebrook Owen Magraw the Elder being in company with the afd Bets the said Magraw told him that Down on that point deserting his hand toward the place above discribed stood the upper most bounder of colebrook or M.r Whitty Land for that he the said Owen Magraw had marked the said bounder with his own hands that William Waller above Mentioned Declared that Richard Whitty in his Life time had often acknowledged the place and tree above Mentioned as his uppermost bounder of Colebrook and further saith not Taken before us the 7.th day of may Ann Dom 1731 Rob.t King Tho.s Brown Tho.s Gillis George Phebus aged Seventy Years or thereabouts deposeth on the Holy Evangelist of almighty God that he has seen a white Oake tree marked as a bounder that is now Gone Standing on a point of high Land a little below a Glad that Issues out of Goose creek a small Distance from W.m Jones house down the creek near to ^a^ dead Red oake Saplin which this Deponant has been severall times at with his master Whitty and once with Coll David Brown in company and that the tree and place aforesaid that this Deponant is now at and from whence he this deponant has been the line of COlebrook Run two or three times was deem'd and Reputed as the Uppermost bounder of the afd Tract called colebrook formerly in the Possession of Richard Whitty deceast George Bazeman the Elder the first of that name that seated on Monken River was the first pson that shewed this deponant the above markt white oak and that his Master afd always acknowledged it was his Uppermost bounder of Colebrook afd and that this Deponant had Information to the Same Effect of what is above Mentioned Relateing to the white oak Tree afd from many other psons and further saith not Take before us the Subscribers this 7 day of may Ann.o D.o 1731 Rob.t King Tho.s Brown Tho.s Gillisse |
