88 two of you hands to us to our county court of somerset with all convenient speed Wittness William Planner Gent.m one of our Justices of our said Court the twentieth day of mar: in the Sixteenth Year of our Dominion &.c Ann Dom one thousand seven hundred and thirty On the back side of the foregoeing Commission it was Endorsed and Likewise to the Same Commission it was Annexed as Followeth viz.t May 7.th 1731 Then Robert King Thomas Gillis Philip Covington and Thomas Brown the within Commissioners Came before me the Subscriber One of the Lord Proprietarys Justices of the peace for the county of somerset and took their oaths on the Holy Evangelist of Allmighty God to Execute the within comission Justly Truly and Impartially According to the Direction of an act of assembly of this province in that case made and provided and according to the best of their Judgment and knowledge Sworn to before me ye day and year above W.m Stoughton Wee the Subscribers do hereby Certifie that Notice has been given as Required by act of assembly before the taking the Examination of these Wittnesses whos deposition are hereunto anexed this 15.th day of may Anno Dom 1731 Rob.t King Thom.s Browne Tho.s Gillis Phill Covington Cap.t William Turpin aged fifty ^three^ years or there abouts deposeth on the holy Evangelist of Almighty God that about twenty four or five years since he this deponant haveing Intermarried with the Daughter of M.r Richard Whitty who was herr to the Land called colebrook he was pres^en^t at the Enquirey of a Jury into the bounds of the afd Land Called Colebrook and Remembres that Geo Phebus and W.m Walter being sworn did say that M.r Robert Whitty now Dece^a^st allways acknowledged the white oak tree mentioned to Stand on a point near to the mouth of a small Glade Issueing out of Goose Creek a Little below William Jones houses where this deponant now Stands and where there is this day a mulbery post marked with Sixteen notches put up near a dead Red Oak Saplin mantil (as the upper most bounder of Colebrook or whittys Land aforesaid) taken before us this 15.th day of may anno D.o 1731 Robt King Thos Brown Thomas Dashiell aged Sixty Five Years or thereabouts deposeth on the holy Evangelist of almighty God that about twenty four or five years since as near as this deponant can remember he was on a Jury with Robert Laws and Some Others to Enquire into the bounds of a tract of Land Call'd Colebrook formerly in the possession of Richard Whitty at which time they Came to a point on Goose Creek a Little below Wm Jones house near to the mouth of a glad where there now Stands a dead Red oak Saplin markt near to which Geo.e Phebus being Sworn did say stood a markt white oak tree w^h^ich M.r Whitty or his Master Whitty did always acknowledge as his uppermost bounder of Colebrook and that William Walter being Sworn said that he well Remember that M.r Whitty did Acknowledge the above white oake as his uppermost Bounder of Colebrook And further this Deponant saith that George Bets was sworn at the time and place aforesd who Declared that as he was passing by along the Road opposit to the point where this Deponant now Stands in company with Owen (Magrow) |
