on behalfe of a Certain Thomas Dashiell of the county afd in relation to the bounds of part of a tract of Land Lying in the county afd Called Garshemain we therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall seem convenient you meet on the afd Land Called Garshemain you first having taken your oaths on the Holy Evangelist of almighty God According to act of assembly in such case made and provided and there cause to come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated by the said complainent or Def.t if any and that you or any three or two of you Examine them upon their corporall oaths to be by you or any three or two of you Administred on the holy Evangelist of Almighty God in the presents of the said complainent or Def.t if any touching the truth or Remembrances of their knowledge or any thing that may relate to the cause afd and that reduceing the Severall Doposition into writing you send the same together with this our commission under your or any three or two of your hands to us to our county court of somerset with all convenient speed Wittness Sam.ll Hopkins Gent.m chiefe Justices of our said court the Nineteenth day of march in the tenth Year of our Dominion &.c Ann Dom one thousand seven hundred and twenty five June the fifteenth day ann Dom One thousand Seven Hundred and thirty One Came here Into Court George Scott and Thomas Humphrys two of the Commissioners above Nominated and made return of the Same Commission thereon endorsed with the Severall affidavitts thereunto annexed viz.t march ye 8.th 1726 Came Mr George Scott before me the Subscriber One of his Lordship Justices of the peace for Somerset County and was sworn ^on the holy Evangelist^ well and truely to Execute the within Commission according to act of assembly in that Case made and provided Sworn before me James Dashiell February ye 25.th 1726 Came the within Mentioned Thomas Humphrys before me John Handy One of his Lordships Justices of the peace for the County of Somerset and made Oath on the Holy Evangelist of Almighty God to Execute the within Commission according to act of assembly in Such Case made and provided Jno Handy Maryland Somerset County August the 19th day 1726 These are to Certifie that we the Subscribers by Vertue of his Lordships Commission to us directed from his Lordships Commission to us directed from his Lordships Justices of Said County to Examine Evidences to the boundarys of a tract of Land Called Gethsemain for Nine hundred acres which tract of Land is in the possession of Christopher Nutter and other sundry persons of Said County at whose prayer said Commission Issued bearing date the 19.th day of august 1726 according to an act of assembly we did sett up our notifications under our hands in Stepney Parish vizt at Church Chapple and Other publick places above thirty days before we mett on Said Land and having appointed by our said Notifications to meet on Said Lands the twenty fourth day of October 1726 so accordingly mett on the Said day having sumoned W.m Geills, Ja Mcmorie, Thomas Willson, John More Sen.r of the Forrest RIchard Rider, James Weatherly, Mary Such John Nicholson, Benjamin Waile for evidence in the presents of both parties we did proceed and being brought by William Geills and the Rest of the abovesaid Evidences down to the north Side of quanticoe Creek by the side of a marsh where now a mulberry post stands which post stands eighty yards to the Eastward of a Gully that |
