Somerset ss  Charles absolute Lord and Proprietary of the provinces of Maryland and avalon Lord Baron of
Baltemore &.c  To the Sher of Somerset County Greeting we Command you that you attach any the Goods
and Chattells Rights or Creditts of Robert Ware Late of Somerset County planter if they Shall be found
in your bailywick to the value of Eighty four pounds Six Shillings Currant money and three thousands
One hundred and fifty pounds o tobacco and when you have the Same attached or any part thereof
the Same in your Custody Safe keep so that you have the SAme before our Justices of ^our^ his Lordships County
Court of Somerset to be held at at dividing Creek the third tuesday of June next then and there to
be Condemned according to act of assembly to and for the use of a Certain Southy Whittington
unless the Said Robert Ware by himselfe or attorney shall appear and answer unto the Said Southy
Whittington in a plea of trespass upon the Case &c according to Law and that by Good and Lawfull men
of your Bailywick you make known unto the person or persons in whose hands you make the Same
attachment that he She or they be and appear before Our Justices of Our County Court of to be held as afd
to Shew Cause if any he She or they have why the Same Goods Chattells Rights or Creditts so attached in
his her or their hands ought not to be Condemned and Execution thereof had and made according to the
form of the act of assembly in Such Case made and provided if to him her or them it Shall mete &
how you Shall execute this writt that you make known unto Our Said Justices at the day and place afd
and have you then and there this writt wittness William Planner Gent One of Our Justices of our
Said Court the twentieth day of march in the Sixteenth Year of Our Dominion &.c anno Dom one thousand
seven hundred & thirty &c

          Att which Said third tuesday of June to witt the fifteenth day of the Same month anno Dom one
thousand seven hundred and thirty one being the day of the Return of the Said Writt Cometh the Said
Southy Whittington by Levin Gale his attorney and the Sher of Somerset County to whom the foregoeing
writt was directed Comes and makes Return thereof to the Court here Endorsed vizt   To the worshipfull
Justices within Mentioned I Certifie that I have attached as the Goods and Chattells of the within
Named Robert Ware to the Value of fifty four pounds Sixteen Shillings and three pence as appears
by a Certain Shedule hereunto annexed and have delivered the Same Goods and Chattells to the within
Named Southy Whittington &.c so answers John Purnall sher

    Whereupon the afd Southy Whittington by his attorney afd prays that upon Giving Security according
to act of assembly the Goods and Chattells ^of ye afd Robt Ware^ so as afd attached to the Value of fifty four pounds sixteen
Shillings and three pence may be Condemned towards Satisfying unto him the Sum of Eighty four pounds
Six Shillings Currant mony and three thousand one hundred and fifty pounds of tobo

         Thereupon a Certain Francis Allen of Somerset County Gent.m present herein Court undertakes for the Said
Southy Whittington according to act of assembly that in Case the Said Robert Ware do at any time appear
within a year and a day and make all or any part of the Said Southy Whittingtons Claim against him
to be satisfied or otherwise to have been undue before the Laying of the attachment afd that then he the
Said Southy Whittington Shall make Restitution unto him the Said Robert Ware of all or such part thereof
as shall be so made appear to be undue &c or that he the said Francis Allen will do it for him &c
Therefore it is Considered that the afd Goods and Chattells to the value of fifty four pounds ^sixteen Shills & three pence^ so as afd attached may
be Condemned as the Rights and Creditts of the afd Robert Ware towards Satisfying unto the Said Southy Whittington
the afd Sum of Eighty four pounds Six Shillings Curr mony & three thousand One hundred & fifty pounds of tobacco
and that he have thereof Execution &c
