1731 85 Duncan late of Somerset County Schoolmaster the tenth day of aprill in the Year of our Lord God one thousand Seven hundred and thirty One at Somerset County aforesaid within the Jurisdiction of this Court with force and armes One Spannish pistole of the value of twenty two Shillings Currant mony of the proper Goods and Chattells of a Certain Joshua Caldwell of the Same County planter then and there being found then and there feloniously did take Steal and Carry away against the peace of the Said Lord proprietary his Good rule and Government and Contrary to the form of the act of assembly in that Case made and provided &c L Gale Cl Indicts Testes Andw Rathbourn, Jos: Leonard, Joshua Caldwell Thomas Caton & Brent Nuttall On the back side of the foregoeing Bill of Indictment it was thus Endorsed viz.t Ignoramus Nicholas Fountain Foreman Whereupon the Said Thomas Duncan being Called appears and thereupon the Said Thomas Duncan is ordered to Give Security for the payment of the Severall Officers their fees due by Occasion of the premisses afd but for want thereof the Said Thomas Duncan is Committed into the Custody of the Sher of Somerset County there to remain &.c Afterwards in the Same Court Came a Certain Joshua Sturges and Patrick Connelly of Somerset County and undertakes for the Said Thomas Duncan to pay the Severall Officers their fees due by Ocasion of the premisses if the Said Thomas do not pay the Same &.c thereupon the Said Thomas Duncan is discharged from the Committment afd &c Milford a negro Boy of John Finch is adjudged by the Court to the age of twenty One Years &c
this province You are hereby required Immediately to Issue attachment against the Effects of the Said Ware for the Said debt and all additional Costs and Charges that Shall a Crew thereon according to the form of the act of assembly in that Case made and provided hereof fail not at Your perill and for so doeing this Shall be Your warrant Given under my hand and Seal the twenty Sixth day of March anno Dom One thousand Seven hundred and thirty one To Thomas Hayward Cl Somerset County John Scott (Seal) Robert Ware Dr To my being his Security for the Estate of Sarah Kirke orphan of John Kirke dec.d the which I am Obliged to pay on account of his being runaway &c £64..6..0 1729 To your note past to me for 20..0..0 and fifteen hundred pounds of tobacco Errours Excepted P me Southy Whittington March ye 27.th 1731 Then Came before me the Subscriber One of his Lordships Justices of the peace for Somerset County Southy Whittington and made Oath upon the holy Evangelist of Almighty God that the above account is Just and true and that he hath received nor part nor percell thereof the Same nor any thing in Satisfaction John Scott Pursuant to an act of assembly of this province now in force and by vertue of the above warrent was Issued the following attachment against the Goods and Chattells rights & Creditts of Robert Ware &c Somrsett ss Charles |
