Justices of the Same Court and Gives the Court to understand and be Informed that Thomas Cuningham Late of Somerset County planter the thirtieth day of June one thousand Seven hundred and thirty at Somerset County aforesaid within the Jurisdiction of this Court did Committ fornication with a Certain Sarah Jackson against the peace of the Said Lord proprietary and also against the form of the act of assembly in Such Case made & provided wherefore ye Said Levin prays advisement of the Court in the premisses and that due process of Law may Issue &.c L Gale P Dom Propry Thereupon Command was Given to the Sher of Somerset County that he Should take the Said Thomas Cuningham if &.c to answer &.c and afterwards in the Same Court Came the Said Thomas Cuningham by William Becking his attorney and Says that he Cannot Gainsay but that he is Guilty of the premisses above upon him Imposed and is willing to pay his fine for the fact aforesaid &c whereupon all and Singular the premisses by the Court here being seen heard and fully understood Wherefore it is Considered that the aforesaid Thomas Cuningham pay unto his Said Lordship the Lord Proprietary thirty Shillings for his fine by occasion of the premisses above upon him Imposed and that the Said Thomas Cuningham be taken to Satisfie his Said Lordship of the fine afd &c
Whereupon the Said Thomas Duncan with George Parker and Samuel Parker his Securitys all present herein Court in their proper persons acknowledged themselves to Owe and Stand Justly Indebted unto his Lordship the Right honourable the Lord proprietary that is to Say the Said Thomas Duncan in the Sum of Sixty pounds Sterling and the Said George Parker and Samuel Parker in the Sum of thirty pounds Sterling Each of their Goods and Chattells Lands or tenements to the use of his Said Lordship his heirs and Successors seperately to be made and Levied for the If default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above bounden Thomas Duncan do and Shall make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August next and answer unto his Said Lordship of and Concerning a bill of Indictment against him found on Suspicion of Felony and stand and abide the Judgmt of the Court thereon and do not depart the Same Court without Lycence thereof and in the mean while to be of the Good behaviour towards his said Lordship and all his Good people then the above Recognizance to be void and of none Effect otherwise to Stand and remain in full and vertue in Law &c
