75 Richardson in case he would not pass his obligation to him the said James Shirley for the Value of the said Perriangor and Debts due to him amounting as he said to the sum of twenty seven pound Seventeen Shillings and Tenn pence in the condition of the said obligation Mentioned and the said Charles further saith that at the time of passing of the said obligation the said James Shirley did promise to Cancell and make Void the said obligation or Deliver up the same to the said Charles Richardson upon the return of the said Perriangoe & Prisoners being retaken and brought back in costody of the Sher afd whereupon upon the said condition and Promise the said Charles Richardson by the fraud and Covin of the said James Shirley did pass and sign the obligation afd and the said Charles in fact saith that afterwards viz.t on the fourth day of December in the year aforesaid the said Prisoners were retaken and in custody of the Sher afd in Execution for their several Debts viz.t at somerset County within the Jurisdiction of this court and that he the said Charles Richardson did retake and bring back the Perriangoe aforesd and appurtenances to the Landing afd and tentred the same on the day Last mentioned to the said James Shirley who refused to accept of the same and Cancell the obligation afd and that he the said Charles Richardson always from the time afd was ready ^&^ still ready to Deliver the said Perria^n^goe the said James Shirley and did not pass the obligation ^afd^ to the said James Shirley in any other manner or for any other consideration then what is above Expressed and this he is ready to Verifie Whereupon he prays Judgment if ye said James Shirley his accon aforesaid against him thereupon he ought to have and maintain &c Whereupon the said Charles Richardson Relinquisheth his verification aforesaid by him above pretended & says that the writing obligatory aforesaid is the deed of the same Charles nor but that he owes the same James the aforesaid fifty five pounds Fourteen Shillings in manner and form as the aforesaid James above against him declared Therefore it is Considered that the aforesaid James Shirly Recover against the aforesaid Charles Richardson his debt afd and his damages by Occasion of the detaining of the same debt to 1061 One thousand and Sixty One pounds of tobacco to the Same Charles James of his assent by the Court here adjudged and the afd Charles in mercy &c whereupon the afd James here in Court remitteth to ye afd Charles fifty one pound fourteen Shillings ^out^ of the debt afd therefore ^the same Charles^ of the said fifty one pds fourteen shills be quiet &c
Huntington that in Case he be nonsuited in the plea afd or Otherwise Legally Cost that then the Said John Huntington Shall pay the Condemnation of the Court and all Costs accrewing thereon to the Said Robert Adkins or that he the Said Thomas Bluett will do it for him &c |
