73 promise and assumption aforesaid against the aforesaid Jones Ought to Recover whereupon the Justices here according to act of assembly in Such case made and provided at the prayer of the aforesaid Robert and by the Consent of the afd Jones the Justices here assessed the damages of the Said Robert by Occasion of the premisses beyond his Costs and Charges by him about Suit in that part apposed to three pounds nine Shillings and One penny Currant Mony &.c Therefore it is Considered that the afd Robert Smith Administrator of Archibald Smith during the minority of James Smith Executor of the Last will & testament of the afd Archibald Smith dec.d Recover against the afd Jones Records his damages afd to three pounds Nine Shillings & One penny Curr.t mony by the Justices aforesaid in form afd assessed as also Six hundred and Ninty 690 pounds of tobacco for his Costs and Charges afd to the Same Robert Smith at his Request by the 690 Court here of his assent adjudged and the afd Jones in Mercy &c
Currant money which to him he ows and Unjustly Detains &.c And Whereupon the same Ephraim Willson by Levin Gale his Attorney saith that whereas the afd Anthony the fifteenth day of June Ann Dom one thousand seven hundred and twenty four at Somerset County within the Jur of this court by his Certain Writing Obligatory Granted himself to be Held and firmly Bound unto the afd Ephraim Willson In the afd sum of fifty six pounds Eighteen Shillings and two pence currant money to be paid the said Ephraim when afterwards he should be thereunto requested yet the afd sum of Fifty Six pound Eighteen Shillings and two pence Currant money unto the same Ephraim hath not Rendred but the said Anthony the same to render hath Denyed and still doth Deny and Unjustly detain whereby the same Ephraim says he is worse and hath Damage to the Value of forty pounds and thereof he brings this Suit &.c And the said Ephraim brings hereinto court the writting obligatory afd with &.c L Gale P Quere pledges Jno Doe R Roe And the aforesaid Anthony West by Francis Allen his attorney Comes and defends the force and Injury when &.c and prayed leave to Imparle hereunto untill the next Court and he had it and the same day is Given to the aforesaid Ephraim here also &c Att which said next Court to witt the Sixteenth day of March Anno Dom One thousand Seven hundred and thirty Came againe as well the afd Ephraim Willson as the aforesaid Anthony West by their attorneys afd and the Said Anthony Says that he Cannot Gainsay the action aforesaid of the aforesaid Ephraim nor but that the writing Obligatory afd is the deed of the Same Anthony nor but that he Owes the same Ephraim the afd fifty six pounds Eighteen Shillings & two pence Currant money in manner & form as the afd Ephraim above against him declared Therefore it is Considered that the afd Ephraim Willson Recover against the afd Anthony West his debt aforesaid as also his damages by Occasion of the detaining of the Same debt to three hundred and fifty Nine 359 pounds of tobacco to the Same Ephraim of his assent by the Court here adjudged & ye afd deft in mercy &c |
