nor to Either of them hath paid or contentented altho' the same to do the said Jones
by the said Archibald in his Life time to witt on the afd thirtieth day of october
in the year aforesd and often afterwards and by the said Robert since ye decease
of the said Archibald to witt on the first day of may Ann Dom seventeen hundred
and thirty and often afterward at Somerset County aforesd within the Jur afd
he was thereunto requested but the Same to the said Archibald in his Life time
or to the aforesd Robert in his said capacity to pay hath refused and the said Jones
the same to the said Robert in his said Capacity to pay still doth refuse and
Deny whereupon he saith that he is worse and hath Damage to the Value of tenn
pounds Currant money of Maryland aforesd and thereupon he brings suit &.c
And be brings into court here his Lettrs of Admrcon by which &.c

of Archibald Smith dec.d during the Minoryty of
James Smith &.c and proved the above Account
According to act of assembly in such case provided &.c

       And the Said Jones Records by Levin Gale his attorney comes and defends the force and Injury when &c
       and prays Leave thereof to Imparle here untill the next Court and he had it and the Same day is
       Given to the afd Robert here also

                Att which said next Court to witt the Sixteenth day of march ann.o Dom One thousand Seven hundred
                and thirty Came againe the Said Robert Smith by his attorney aforesaid and prays that the afd Jones
                to his declaration aforesaid may answer but the Said Jones altho Solemnly Called Came not nor Says
                Nothing in bar or preclusion of the action aforesaid by which the Same plft Remaines against the
                Said deft thereupon undefended &c

                      Wherefore the Said Robert Smith his damages by Occasion of the non performance of the
                                                                                                                                                   promise
