The above accot Swore to in open Court Test Thos Hayward Cl And the afd Benjamin Sharp by James Shirley his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle hereunto untell the next Court and he hath it and the same day is Given to the aforesaid plft here also &c Att which said next Court to witt the Seventeenth day of November anno Dom One thousand Seven hundred and thirty Came againe as well the afd John Stewart as the afd Benjamin Sharp by their attorneys afd and whereupon the Said Benjamin prays further Leave thereof to Imparle here untill the next Court and he had it and the Same day is Given to the aforesaid John here also &c Att which Said next Court to witt the Sixteenth day of March anno Dom One thousand Seven hundred and thirty Came againe as well the aforesaid John Stewart as the aforesaid Benjamin Sharpe by their attorneys aforesaid and whereupon the Same Benjamin by his Said attorney as before defends the force and Injury when &.c and Saith that he did not assume upon himselfe in manner and form afd as the aforesaid John Stewart above against him hath declared and of this he putts himselfe upon the country &.c and plft in Like manner Thereupon Command is Given to the Sher of Somerset County that Immediately he Cause to come here twelve &.c by whom &.c who neither &.c to recognize &.c because as well &.c of which Said preceipt the Said Sher to witt John Purnall Sher Gent now hereat to witt the Same day and Year Last mentioned makes Return that he hath here Ready twelve &.c as by his Said preceipt he was Commanded and now hereafterwards to witt the Same day and Year came as well the afd John as the aforesaid Benj.a by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise came to witt James Rownd, William Jones, Thomas Reyley Isaac Marshall, Edward Franklin, John Holland John Townsend Sen.r, William Right, Thomas Collins Daniel Boyce, James Houston John Webb who being duely elected tryed and Sworn to Say the truth in the premisses upon their Oath do Say that the afd Benjamin Sharp did not assume upon himselfe in manner and form as the aforesaid John Stewart above against him hath Complained &c Therefore it is Considered that the aforesaid John Stewart take nothing by his writt and declaration afd but be thereof in mercy for his falce Clamour and that the Said Benjamin Sharpe Goe thereof without day &.c and further it is Considered that the aforesaid Benjamin Sharp Recover against the Said John Stewart Six 687 hundred and Eighty Seven pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Benjamin by the Court here of his assent adjudged according to the form of the Statue in Such Case Lately made and provided and that the afd Benj.a have thereof Execution &.c
