69 the sun set of the same day was ready to pay unto the aforesaid francis in his Life time the Heading corn and Pork which by the Condition aforesd he was oblidged to pay the said Mercer and that he yett is ready and allways since Hath been ready to pay the thirty pounds in ye Condition aforesd Mentioned in heading Corn and Pork according to the forme and Effect of Manner Thereupon Command was Given to the Sher of Somerset County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &c to Recognize &.c because as well &.c of which Said preceipt the Said Sher to witt John Purnall Gent now hereat this day to witt the Sixteenth day of March anno Dom One thousand Seven hundred & thirty makes Return that he hath here Ready twelve &.c as by his Said preceipt he was Commanded and now hereafterwards to witt the Same day and Year Came as well the afd Plft as the Said deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called ^likewise^ Came to witt James Rownd, Wm Jones manocan Isaac Marshall, Thomas Reyley Edward Franklin, John Holland John Townsend, W.m Right, Thomas Collins Daniell Boyce John Webb, James Houston who being duely Elected tryed and Sworn to Say the truth of their Knowledge in the premisses afd Say that upon their Oath doe Say that the afd Philip Quinton on the afd fifteenth day of September one thousand Seven hundred & twenty Eight was Ready to pay unto the afd Francis Mercer in his Life time the heading Corn and pork in the Condition of the obligation afd mentioned and that he always was and now is Ready to pay the Same in manner and form as he above hath alledged &c Therefore it is Considered that the afd John Stewart Executor of the afd Francis Mercer take nothing by his writt & declaration afd but be in mercy for his falce Clamour and that the afd Philip Quinton Goe thereof without day &c
County within the Jurisdiction of this Court was Indebted unto the Said John in thirty Six Shillings Currant mony of maryland for Sundry Goods wares and Merchantdizes by the Said John to the Said Benjamin at the Speciall Instance and request of the Said Benjamin before that time there Sold and delivered as by account hereunto annexed may appear and being so thereof Indebted the said Benj.a in consideration thereof the day and year aforesd at the place aforesd in the County aforesd upon himself did assume and to the said John then and there did faithfully promise that he the said Benjamin the aforesd thirty Six Shillings to the said John when he should be thereunto requested he would well and faithfully pay and Content Nevertheless the said Benjamin hs promise and assumption aforesd in forme aforesaid made Nothing regarding but plotting & fraudulently Intending the said John in that part Craftilly and Subtilly to Deceive and Defraud the said thirty Six Shillings to the said John altho' the same to Doe the s.d Benajmin by the said John on the aforesd fifteenth day of December in the year aforesd and often afterwards at the County aforesd within the Jur aforesd he was thereunto requested hath not paid or Contented but the same to him hatherto to pay or Content hath refused and still doth refuse and Deny to the damage of the said John of three pounds twelve shill.s money aforesd and thereupon he bring Suit &c F Allen P Qrte Pledg dep John Doe R Roe |
