7 Above James Gibson never paid any part of the above debt of forty Six pounds Sterling but that it Remains really and bona fide due and owing to the Said Betty Gale from the said James Gibson John Jones Mr Thomas Hayward June 18 1730 It being made appear to me John Jones one of the Lord Proprietarys Justices of the peace for Somerset County that the within James Gibson is actually Runaway & has or is about to Remove his Effects out of this province to deceive his Creditors You are hereby required to Issue attachment for the within Betty Gale against the Within James Gibsons Estate in the Usuall form for the within sum of Forty Six pounds Sterling and the Incident Costs and Charges according to the form of the act of assembly in Such Case Lately made and provided and for your soe doing this shall be your Warrent John Jones Pursuant to an act of assembly of this province in such Cases made and provided and now in force the following attachment was Issued against the Effects of the afd James Gibson the tenor whereof followeth in these words viz.t Somerset ss Charles absolute Lord and Proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the sher of Somerset County Greeting we Command you that you attach any the goods or Chattells Rights or Creditts of James Gibson Late of Somersett County Merch.t ^if they shall be found in your Bailywick^ to the Value of forty ^six^ Pounds Ster.l and Eight hundred pounds of Tobacco And when you have the same so attached or any Part thereof the same in Your Custody safe keep so y.t you have them before the Justices of our County Court to be held at Dividing Creek the third tuesday of August Next then and there to be Condemned According to Act of Assembly to & for the use of a Certain Betty Gale unless the Said James Gibson By himselfe or his attry shall appear & answer unto the said Betty Gale of a plea of trespass upon the Case &.c According to Law & that by Good & Lawfull Men of Your Balywick you Make Known unto the person or persons in Whose hands You Make the Same Attachment that he she or they ^be and appear before ye Justices of our County Court to be held as afd to shew Cause of any he she or they have^ have why the SAme Goods Chattles rights or Creditts so attached in his her or their hands Ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in such Case made and provided if to him her or them it shall seem mete and how you shall Execute this writt that you make known unto Our said Justices at the day and place afd and have you then and there this writt Wittness W.m Planner Gent One of Our Justices of Our said Court the Seventeenth day of June in the Sixteenth Year of our Dominion &c Anno Dom One thousand seven hundred and thirty Att which said third tuesday of August to witt the Eighteenth day of the same month one thousand seven hundred and thirty being the day of the return of the aforesaid Writt Cometh the afd Betty Gale by Levin Gale her attorney and the sherr of Somerset County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt By Vertue of the within Writt to me directed to the Justices within mentioned that I have attached in the hands of the within Named Betty Gale three Negroes of the Value of forty Nine pounds Currant Money of Maryland as the goods and Chattells of the within Named James Gibson as by ^a^ Schedule hereunto Annexed as by the within Writt I am Commanded John Purnall sher Sumerset County ss We the Subscribers do value the after Named Negroes being the proper goods of Jam.s Gibson and for the Use of Mad.m Betty Gale viz.t One Negro Woman Named Pleasant @ Twenty Eight Pounds One Negro Boy Named Jam.s @ Twelve pounds One Negro boy Nabb @ Nine pounds Currant Money of Maryland the whole being Forty Nine pounds Currancy as Wittness Our hands Thomas Hoolbrook Benj.a King Jam.s Lindow Tho.s Cary Whereupon the afd Betty Gale by Levin Gale her attorney afd Comes and prays that the afd three Negroes of the Value of forty Nine pounds Currant Money ^so^ as afd Attached as of the Rights and Creditts of the afd James Gibson may be Condemned towards Satisfying unto the afd Betty Gale the afd Forty Six pounds Sterling and also all Costs accrewing upon the writt of attachment afd Therefore it is Considered by the Justices here the Eighteenth day of August Anno Dom One thousand seven hundred and thirty that the afd Negroes so as afd attached of the value of forty Nine pounds Currant money |
