money may be Condemned in the hands of the said Betty Gale as of the Rights and Creditts of the said James Gibson towards
Satisfying of the said Betty Gale as well the afd sum of forty Six pounds Sterling as also the Costs accrewing upon the
writt of attachment and that she have thereof her Exn &c

Memorand.m the plft by Levin Gale his attorney sued out his Lordships writt of Scirefacias against
the defend.t the tenor whereof followeth in these words viz.t
Somerset ss    Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord
Baron of Baltemore &.c  To the sher of Somerset County Greeting  Whereas a Certain Randall West late of
Somerset County [illegible] in our County Court of Somerset hereto witt the Ninteenth day of august one thousand seven hundred
and twenty Nine [illegible] Hopkins Gent.m and his associates then Our Justices at Dividing Creek in Our County afs.d
assumed upon [illegible] did undertake for a Certain W.m West late of Somersett County Planter that in Case a Certain
Vachell Denton [illegible] recover Judgm.t against the af.d W.m West in a Certain Plea of trespass upon the Case by the
Same Vachel [illegible] afs.d W.m in Our Same Court Prosecuted or that the same W.m should be therein Convict
that there [illegible] all the damages when to the same Vachell against [illegible] in our Same Court
[illegible] here in the afd plea of trespass
upon the Case [illegible] that Should be adjudged would Satisfie or his Body in Execution of Such Judgm.t
to the [illegible] Somersett County would Render that he the Said Randall West would do the same for
him & [illegible] Vachell afterwards to in the same day & year af.d in Our Same Court before
the Same [illegible] John Hopkins Gent.m & his associates then Our Justices of Somersett County Court at Dividing
Creek afs.d [illegible] of the Same Court recovered against the af.d William West two pounds fifteen
Shillings [illegible] Currant Mony of and two hundred & sixty pounds of Tobacco for his damages which
he Sustained [illegible] Occasion of a Certain promise and assumtion to the Same Vachell by the af.d W.m
Made & [illegible] whereof he is Convict afd by the records & proceedings thereof in Our Same Court
before [illegible] Dividing Creek af.d manifestly appeareth Nevertheless the af.d W.m his Body in
Execution [illegible] to the af.d Sher of Somersett County hath not rendered nor the same W.m the
damages of [illegible] Vachell hath not satisfied or paid nither hath the af.d Randall West done the
same for him as by Insinuation of the af.d Vachell we have received & Because we are willing that the
things which [illegible] Our Said Court are rightfully acted and acknowledged ought to be Duely Executed
We Command you that by honest & Lawfull men of Your Bailywick you make known unto the
af.d Randall West that he be and appear before Our Justices of Our County Court of Somerset to be held at dividing Creek the
third tuesday of August next to shew Cause if any thing for himselfe he hath or knoweth to say wherefore the afd Vachell his
Execution of the Damages afd against him Ought to Recover according to the form of the recognizance aforesaid if unto him it should
seem expedient and have you then and there Names of them by Whom to him you make the same known and this writt Wittness
W.m Planner Gent One of our Justices of Our Said Court the seventeenth day of June in the Sixteenth Year of Our Dominion &c
Anno Dom one thousand seven hundred and thirty

                Att which said third tuesday of August to witt the Eighteenth day of the same month one thousand seven hundred
and thirty before his Lordships Justices at dividing Creek Cometh the afd Vachell Denton by his attorney afd and the sher
of Somerset County to witt John Purnall Gent.m at the same day Returned that he by vertue of the writt aforesaid
to him directed had made known unto the afd Rachell West by Hugh Porter and John Doe honest and lawfull men
of his bayliwick that he be before his Lordships Justices of the County Court of Somerset to be held at the day and
place aforesaid to show in form afd &.c as to him ^it^ was Commanded and the aforesaid Randall so forewarned and
at the same day day being solemnly Called Cometh not but makes default

                 Therefore it is Considered that the afd Vachell Denton have his Execution against the afd Randall West
of two pounds fifteen shillings and one penny Currant Money and two hundred and sixty pounds of tobacco his damages afd according
ll tob    to the force form and Effect of the recognizance afd likewise the afd Vachell Denton according to the form of the Statute in such
233      Case lately made and provided Recover against the afd Randall West Two hundred and thirty three
pounds of tobacco for his Costs Charges and damages which he sustained by occasion of delay of Execution of the damages aforesaid &c
