68 handker^c^hiafs one Gunters seale one Ink horn about five or six pounds of shott sundry Gunn Flint one new fishing Line of this fathom one & half worn one can with Eleven Bottles three or four pounds of Lead Sinks for fishing sundry hooks and one Ligunur vita Cupp of the value of twelve pounds Currant money of Maryland as of his proper Goods and Chattles and being so thereof Possessed the said James Edwards afterwards to witt the day and Year aforesd at the County of Somerset aforesaid within the Jur aforesd the Goods and Chattles aforesd out of his hands and possession casually Last which said Goods and Chattles afterwards to wit the day and Year and place aforesaid within the Jur aforesd to the hands and Possession of the aforesaid James Lindow by finding came Nevertheless the aforesaid James Lindow knowing the goods and Chattles afd of the aforesaid James Edwards and to him the said James Edwards of right to belong and appertain but Plotting and fraudulently Intending the same James Edwards of the Goods and Chattles aforesaid Craftilly and Subtilly to Deceive and Defraud the Goods and Chattles aforesaid tho' oftenn thereunto requested to the said James Edwards hath not Delivered but the goods and Chattles aforesaid afterwards to witt on the first day of March Anno Dom seventeen hundred and twenty Nine at Somerset County afd within the Jurisdiction aforesaid to his one proper use did Convert and Dispose to the Damage of the Said James Edwards of twenty four pounds Currant Money of Maryland afd and thereof he brings Suite &.c F Allen P Qrte Pledg dep Jno Doe R Roe And the said James Lindow by James Shirley his Attorney Comes and Defends the force and Injury when &.c and prays Leave thereof to Imparl here untell the Next Court and he had and the same day is Given to the afd plef.t here also Att which said Next Court to witt the Eighteenth day of Aug.t Ann Dom one thousand seven hundred and thirty came again as well the aforesd James Edwards as the aforesd James Lindow by their attorneys aforesaid and whereupon the same James ^Lindow^ prays further Leave to Imparl here untell the Next Court and he had it and the same day is Given the aforesaid James ^Edwards^ here also &c Att which said Next Court to witt the seventeenth day of Novemb.r Ann Dom one thousand seven hundred and thirty came again as well the aforesd James Edwards as the aforesd James Lindow by their Attorneys aforesaid and whereupon the same James ^Lindow^ prays further Leave to Imparl here untell the Next Court and he had it and the same day is Given the aforesd James ^Edwards^ here also &.c Att which said Next Court to witt the Sixteenth day of March Ann Dom one thousand seven hundred and thirty came again as well the aforesaid James Edwards as the aforesaid James Lindow by their Attorneys aforesaid and the Said James Lindow as before defends the force and Injury when &.c and Saith that he is in noe Sort Guilty of the premisses above upon him Imposed and of this he putts himselfe upon the Country &c And the plft in Like manner and whereupon the aforesaid James Lindow Relinquesheth his verification aforesaid by him above by pretense Says that he Cannot Gainsay the action aforesaid of the aforesaid James Edwards nor Can he Say but that the Said James Edwards Ought to Recover his damages by occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to Eight pounds tenn Shillings and Eight pence Curr.t mony and not more and because the afd James Edwards denyes not this but |
