68 but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties aforesaid to the aforesaid Eight pounds tenn Shillings and Eight pence Curr.t mony by the Same James Lindow in form aforesaid Confessed as also three hundred & thirty seven 337 pounds of tobacco for his Costs and Charges aforesaid to the Same James Edwards at his Request by the Court here and Consent of the parties aforesaid adjudged and the afd James Lindow in mercy &c
of a plea of that he render unto him sixty pounds Currant Money of said Province which from him he Unjustly Detains &.c And Whereupon the Said John by Francis Allen his Attorney Saith that whereas the said Philip the first Day of June Anno Dom one thousand seven hundred and thirty Eight at Somrset County aforesd within the Jurisdiction of this Court by his Certain writing obligatory which the said John with the Seal of the said Philip signed hereinto Cort brings the Date whereof is the same day and Year did acknowledge himself to be bound unto the said Francis Mercer in his Life time in the aforesad Sixty pounds Money aforesd to be paid unto the said Francis Mercer when he should be thereunto required Yett the said Philip tho' often required the said sixty pounds to the said Francis Mercer in his Life time or to the aforesd John since the Decease of the said Francis Mercer to render hath denyed and the same to the said John to render Still Doth Deny and Unjustly detain to the Retarding him in the Execution of the Last will and testament aforesaid whereupon the said John saith he is worse and hath Damage to the Value of forty pounds Money afd And thereupon he brings Suite and brings into Court the Leters Testary of the aforesd Francis Mercer by which &.c F Allen p Qrte Pledg dep Jno Doe R Roe And the afd Philip Quinton by Levin Gale his attorney comes and defends the force and Injury when &c and pray Leave to Imparle here untill the next Court and he hath and the Same day is Given to the afd Plft here also &c Att which Said next Court to witt the Seventeenth day of November Anno Dom One thousand Seven hundred and thirty Came againe as well the aforesaid John Stewart as the aforesaid Philip Quinton by their attorneys aforesaid and whereupon the Same Philip Quinton prayes further Leave to Imparle here untill the next Court and he hath it and the same day is Given to the afd Philip here also &.c Att which Said next Court to witt the Sixteenth day of March ann.o Dom One thousand Seven hundred and thirty Came againe as well the afd John Stewart as the afd Philip Quinton by their attorneys aforesaid and whereupon the Said Philip Quinton as before defends the force and Injury when |
