65 Execution against the Same Hannah and John Horsey of the damages aforesaid according to the form & Effect of the Recovery afd &.c Likewise the aforesaid Joseph MccClester according to the form of the Statute in Such case lately made and provided Recover against the aforesaid Hannah and John Horsey's pounds of tobacco for his Costs Charges and damages sustained by occasion of delay 342 of Execution of the damages aforesaid &c
of march then next to answer unto William Turville and Elias Evans of a plea of trespass upon the Case &.c and that thereof he Should not fail &c And the Said William Turvill and Elias Evans by Francis Allen their attorney Complains against the Said Humphry Huay in the plea afd as followeth viz.t Somerset County ss Humphry Huay late of Somerset County planter was attached to answer unto William Turvill and Elias Evans of a plea of trespass upon the Case &c And whereupon the said William and Elias by Francis Allen his attorney Complains that whereas the Said Humphry the Seven^teenth^th day of November Ann Dom seventeen hundred and thirty at Somerset County afd within the Jur of this Court was Indebted unto the said William and Elias in Seven pounds fifteen Shillings and Eleven pence Currant money of maryland as by account hereunto annexed may in Court appear and being so thereof Indebted the Said Humphry the day and year aforesaid at the place aforesaid within the Jurisdiction aforesd in Consideration thereof upon himselfe did assume and to the said William and Elias then and there did faithfully promisse that he the said Humphry the said seven pounds fifteen Shillings and Eleven pence to the said William and Elias when he Should be thereunto requested he would well and faithfully pay and Content and altho' ye said Humphry one pound pcell of the aforesaid seven pounds fifteen shill.s and Eleven pence to the said William and Elias he hath paid and satisfied yet as to six pounds fifteen shillings and Eleven pence residue of the aforesd seven pound fifteen shillings and Eleven pence ^to^ the said Humphry his promise and assumption aforesaid in forme aforesaid made Nothing regarding but plotting and fraudulently Intending the said William and Elias in ^short^ pte Crafftilly and Subtilly to Deceive and Defraud the said six pounds fifteen Shillings and Eleven pence ot the said Will.m and Elias hath not paid or Contented nor to Either of them hath paid or Contented altho' the same to do the said Humphry by the said William and Elias on the aforesaid seventeenth day of Novemb.r in the year aforesaid and often afterwards at the County aforesaid within the Jur aforesaid he was thereunto requested but the same to them hitherto to pay hath refused and Still doth refuse and Deny whereupon they say they are worse and have damage to the value of twelve pounds Money aforesaid and thereupon they bring suit &.c Humphry |
