Court 1730 64 Therefore it is Considered that the Said Sum of Six Shillings and Eight pence Curr.t mony so as afd attached be Condemned in the hands of the Said Co Lazarus Davis as of the Rights and Creditts of the Said Owen Owens towards Satisfying unto the Said John Dennis as well the afd Sum of Six pounds two Shillings and four pence Curr.t mony and two hundred and fifty pounds of tobacco as also al Costs accrewing upon the writt of attachment aforesaid & that the Said John Dennis have thereof his Execution against the Said Lazarus Davis according to act of assembly &c Therefore it is Considered that the afd Sum of five Shillings Curr.t Money so as aforesaid attached be Condemned in the hands of the Said Edmond Hough as of the Rights and Creditts of the Said Owen Owens towards Satisfying unto the Said John Dennis as well the afd Sum of Six pounds two Shillings and four pence Curr mony and two hundred and fifty pounds of tobacco as also all Costs accrewing upon the writt of attachment afd and that the Said John Dennis have thereof his Execution against the Said Edmond Hough according to act of assembly &c
Lately in Our County Court of Somerset here to witt the Seventeenth day of June anno Dom One thousand seven hundred and twenty Nine before Samuel Hopkins Gent and his associates then Justices of Our Said Court at dividing Creek by Consideration of the Same Court Recovered against Hannah Horsey and John Horsey both Late of Somerset County planters two thousand and forty one pounds of tobacco for his damages which he Sustained by Occasion of a Certain promise and assumption to the Same Joseph MccClester by the aforesaid Hannah and John Horseys Lately made and not performed whereof they are Convict as by the Records & proceeding thereof in Our Same Court before Our Justices at dividing Creek Remaining manifestly appeareth nevertheless Execution of the Judgm.t aforesaid as Yett Remaineth to be made as by the Insinuation of the Said Joseph MccClester we have Received and because we are willing that those things which in same Court are rightfully and Ought to be duely executed we Command you that by Honest and Lawfull men of your bailywick you make known unto the Said Hannah and John Horseys that they be before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of March next to Shew Cause if any thing for themselves they have or to say know wherefore the afd Joseph MccClester his Execution of the Judgmt aforesd to have Ought not according to the favour of the recovery afd if to them it Shall Seem Expedient and have you then and there the Names of them by whome to them you make the Same known and this Writt Wittness W.m Planner Gent.m One of our Justices of our said Court the twenty forth day of November in the Sixteenth Year of our Dominion &.c Ann Dom One thousand seven hundred & thirty Att which Said next Court to witt the Sixteenth day of march anno Dom One thousand seven hundred and thirty being the day of the Return of the Said Writt Cometh the Said Joseph MccClester by his attorney aforesaid and the Sher of Somerset County to wtt John Purnall Gent at the Same day returned that he by vertue of the writt afd to him directed he had made known to the afd Hannah and John Horseys by Jacob Hindman and John Doe Honest and Lawfull men of his bailywick that they be before His Lordships Justices at the day and place afd to Shew &.c as to him it was Commanded and the afd Hannah and John Horseys so warned and at the same day being Solemnly Called Cometh not but makes default Therefore it is Considered that the afd Joseph MccClester have Execution |
