63 The Account herewith Sent you proved with the Incident Costs and Charges According to the forme of the Act of Assmbly in Such Case Lately made and provided and for your so doing this Shall be Your warrent as wittness my Hand this 17 day of febry Anno Dom 1730 To Thomas Hayward Cl Jno Scott (seal) Somerset Court
Febry ye 17 1730 Then came Before me the Subscriber One of his Lordships Justices for somerset County John Dennis Sen.r and made oath upon the Holy Evangelist of Almighty God that the Above accout is Just and true and that he hath rec.d no part nor parcel Nor anything in Sattisfaction More then he has given Creditt for Jno Scott Pursuant to an act of assembly of this province now in force and by Vertue of the afd warrent was Issued the following attachment vizt Somerset ss Charles absolute Lord and proprietary of the provinces of Maryland and avalon Lord Baron of Baltemore &.c To the Sherr of Somerset County Greeting we Command you that you attach any the goods Chattells Rights or Creditts of Owen Owens Late of Somerset County Cordwainer if they Shall be found in your bailywick to the Value of Six pounds two Shillings and four pence Currant money and two hundred and fifty pounds of Tobacco and when you have the same attached or any part thereof to the same in your Custody safe keep so that you have them before Our Justices of our County Court of Somerset to be held at Dividing Creek the third tuesday of March Next then and there to be Condemned According to Act of Assembly to and for the Use of a Certain John Dennis Unless the said Owen Owens by himselfe or his attorney Shall appear and answere unto the said John Dennis in a plea of trespass upon the Case &.c According to Law and that by good and Lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they ^be^ and appear before Our Justices of Our County Court to be held as afd to Shew Cause if any he she or they Have why the same Goods Chattles rights or Creditts so Attached in his her or there hands ought not to be Condemned and Execution thereof Had and made according to the forme of the Act of Assembly in Such Case made and provided if to him her or them it Shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place aforesaid and have you then and there this writt wittness William Planner Gent.m one of our Justices of Our said Court ye twenty forth day of November in the Sixteenth Year of Our Dominion &.c Anno Dom One thousand Seven hundred and thirty Att which Said third tuesday of March to witt the Sixteenth day of the Same month ann.o Dom one thousand seven hundred and thirty being the day of the Return of the Said Writt Came the Said John Dennis in his proper person and the Sherr of Somerset County to whom the foregoeing writt was directed Likewise Comes and makes |
