1730 56 Thereupon Command is Given to the Sher of Somerset County that he Should take the Said William Pilchard if &c to answer &.c and afterwards to witt the Sixteenth day of march one thousand Seven hundred and thirty being the Same term Came here into Court before his Lordships Justices for the County of Somerset at deviding Creeks cometh the afd William Pilchard in his proper person and being by the Sher of Somerset County Set to the barr and hath a hearing of the Indictment afd and is thereupon Instantly demanded how he would acquitt himselfe of the premisses afd above upon him Imposed Says that of the premisses afd above by the Indictment aforesaid upon him Imposed he is not Guilty thereof and of this he putts himselfe upon the Country and Levin Gale Esq.r attorney for his Said Lordship who for his Said Lordship in that part followeth Likewise &.c Thereupon Command is Given to the Sher of Somerset County that Immediately he Cause to Come here cause to Come ^here^ hee twelve &.c by whom &.c who neither &.c to recognize &.c of which Said preceipt the Said Sher to witt John Purnall Gent now hereat to witt the Same day & Year Last mentioned makes Return that he hath here ready twelve &.c as by his Said preceipt he was Commanded and afterwards the SAme day & Year came as well the afd Levin Gale Esq.r who for his Said Lordship followeth as the afd William Pilchard in his proper person and the Jurors of that Jury therein Impannelled be^ing^ Called Likewise Came to witt William Lane, Robert Watson, Philip Selby, Bruffe Broughton, Edward Beachamp, John Lane, Hutton Hill, Thos Peal, Jones Records, John Houston, francis Porter, John Atkinson who being duely Elected tryed and Sworn to Say the truth in the primisses upon their Oath do Say that the afd William Pilchard is not Guilty of the premisses in the Indictment aforesaid above Specified &c Therefore it is Considered by the Court here that the afd William Pilchard be quiet & Goe thereof without day &.c whereupon it is ordered by the Court here that the afd William Pilchard Give Security for the payment of the Severall Officers their fees due by occasion of the premisses afd thereupon a Certain William Booth of the county afd present herein Court undertakes for the Said William Pilchard for to pay the Severall Officers their fees due by occasion of the premisses in case ye Said William Pilchard doth not pay the Same &c Thereupon the Said William Pilchard is Ordered by the Court here that to give Recognizance in fifty pounds Sterling with two Securitys in twenty five pounds Sterling Each for his Good behaviour and appearance at June Court next &c Whereupon the Said William Pilchard with William Booth and Edward Cluft of Somerset County his Securitys all present herein Court in their proper persons and acknowledged themselves to Owe and Stand Justly Indebted unto his Said Lordships the Lord proprietary in manner and form following vizt the afd William Pilchard in fifty pounds sterling and the afd William Booth and Edward Cluffe ion twenty ^five^ pounds Sterling Each of their Goods and Chattells Lands and tenements seperately to be made & Levied to the use of his said Lordships his heirs & Successors if default be made in the Condition hereunder written The Condition of this Recognizance is Such that if the above bounden William Pilchard shall personally appear at the next Court to be held for Somerset County at dividing Creek the third tuesday of June next to do and receive what Shall be then and there Enjoyned by the Court and in the meantime that he be of the Good behaviour towards his said Lordship and all other his people then the above Recognizance to be Void and of none Effect Otherwise &c |
