best of his knowledge Sworn to the day & year above before me William Stoughton Whereupon the aforesaid Walter Jacobs in his own proper person appears and thereupon the Said Walter Jacobs at the prayer of the aforesaid Alexander by his attorney aforesaid is adjudged to Give Speciall baile to the action aforesaid Thereupon a Certain Joseph MccClester of Somerset County Gent present herein Court in his proper person undertakes for the Said Walter Jacobs that if in Case the afd Alexander should recover Judgm.t in the plea aforesaid against the aforesaid Walter or that the Said Walter Shall be therein Convict that then he the Said Walter Shall pay the Condemnation of the Court ^thereupon^ or render his body to the Custody of the Sher of Somerset County in Satisfaction thereof or that he ye Said Joseph MccClester will do it for him &c And the aforesaid Walter Jacobs in his proper person comes and defends the force and Injury when &.c and Says that he Cannot Gainsay the action aforesaid of the aforesaid Alexander nor but that he did assume upon himselfe in manner and form as the aforesaid Alexander above against him hath Complained and as to the damage of the Same Alexander by him by Occasion of the premisses in that part Sustained and the Same Walter Saith & Confesseth that the aforesaid Alexander hath Sustained damage by Occasion of the premises further than his Costs and Charges by him about his Suit in that part apposed to five hundred and Eighty four pounds of tobacco and not more And because the aforesaid Alexander denyes not this but the Same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid Alexander Mccfarlane Recover against the aforesaid Walter Jacobs his damages aforesaid to five hundred and Eighty four 269 pounds of tobacco by the Same Walter in form aforesaid Confessed as also Two hundred & Sixty Nine pounds of tobacco for his Costs and Charges aforesaid to the same Alexander at his request by the Court here and Consent of the parties aforesaid adjudged which Certain damages in the whole do amount to Eight hundred & fifty three pounds of tobacco and ye aforesaid Walter in mercy &c
beefe which to him he Owes and ^un^Justly detaines &c And whereupon the Same Christopher by Francis Allen his attorney Saith that whereas the aforesaid Deverix the tenth day of November Anno Dom one thousand Seven Hundred and twenty Nine at Somerset County within the Jurisdiction of this COurt by his Certain Writing Obligatory Confessed himselfe held unto the aforesaid Christopher ^in^ the af.d sum of five hundred and fifty pounds |
