43 one pounds two Shillings and Eight pence Curr.t mony to be paid unto the Said Richard Ackworth and Ann Olphy their heirs Executors administrators or assignes to the which payment well and truely to be made and performed we bind our selves our and either of our heirs Executors and administrators for the whole and in the whole Joyntly & Severally firmly by these presents Sealed with Our Seals and dated this 18.th day of November anno Dom 1730 The Condition of the above Obligation is Such that whereas the Commissary Gen.ll hath transmitted into this Court the accompt of the Estate of Richard Ackworth dec.d wherein it is found that there is ballance due to the abovesaid Richard Ackworth and Ann Olphy the Sum of Sixty five pounds Eleven Shillings and four pence If Therefore the abovesaid Charles Ackworth, Thomas Ackworth, James Hardy and John Huett Nutter or any or either of them or any or either of their heirs Executors or administrators do and Shall well and truely pay or Cause to be paid unto the aforesaid Richard Ackworth and Ann Olphy the aforesaid Sum of Sixty five pounds Eleven Shillings and four pence when they Shall attain to full age according to act of assembly in Such Case made and provided and the decds will &.c then the above Obligation to be void and of none Effect otherways to Remain in full force and vertue Charles Ackworth (seal) Sealed and Delivered Thomas Ackworth (seal) In the presence of James Hardy (seal) Jno Huet Nutter (seal) Jno Handy James Dashiell
at Somerset County aforesaid within the Jurisdiction of this Court was Indebted unto the Said Alexander in that seven hundred and Eighty four Pounds of Tob.o for Ballance as by Acct hereunto Annexed may in Court appear And being so thereof Indebted the Said Walter in Consideration thereof the day and year aforesd at the County aforesd Within the Jur aforesd upon himself did assume and to the s.d Alexander then and there did faithfully promisse that he the Said Walter the aforesd five hundred and Eighty four pounds of Tob.o to the Said Alexander when he Should be there unto requested he would well and faithfully pay & Content Nevertheless the Said Walter his promisse and assumption aforesd in the parte Craftilly to deceive and Defraud the ^said^ five hundred and Eighty four pounds of Tob.o to the Day of September in the year af.d and often afterwards at the County af.d Within the Jur af.d by the af.d Alex.d he was thereunto requested hath not paid or to him hitherto to pay or in any sort for the same to Content hath refused and still doth refuse and deny Whereupon he Saith he is worse and hath damage to the value of one thousand pounds of Tobacco and thereupon he brings Suit &.c F Allen P Qrte Pledges de pd Jno Doe R Roe
