40 Year of Our Dominion &.c anno Dom One thousand Seven hundred and thirty 7.ber 30.th 1730 Came the within named James Martin and James Rownd and qualified themselves to the within Commission taken before me the day & Year above written Sam.l Hopkins In Obedience to a preceipt hereunto annexed we James Martin and James Rownd having Given due notice met the 2.d day of October 1730 on that tract of Land belonging to the above Said Mathew Purnall Called Sherbourn and in the presence of the Complainant (noe deft appearing) Came Capt William Fasitt an evidence aged Sixty Nine Years or thereabouts and being Sworn Saith that to the best of his knowledge and remembrance on the Westermost Side of an Old Indian path goeing a Long a Ridge and to the Eastermost Side of a bald Cypress Swamp there Stood and now Stands a marked Oake which he always understood to be demed and counted a Corner tree of Capt Hammonds land that he then possest which Said Red oak with a bald Cyprus post at the root of it stands to the northward of that plantation where John Hammond Jun.r Son of Edward Hammond Senr decd lived and further Saith not as Wittness Our hands ye day & year abovesaid Jam.s Martin, James Rownd
or two of you to be Our Commissioners to examine Evidences on behalfe of a Certain Nehemiah Holland of the County aforesaid in relation to the bounds of a tract of Land lying in County aforesaid Called Purnalls adventure shall Seem mete Convenient you mete on the aforesaid Land Called Purnalls Adventure [you first having taken your Oath on the holy Evangelist of almighty God according to act of assembly in Such Case made and provided] and there Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you nominated by the Said Complainant (or deft if any) and that you Examine them upon their Corporal Oaths to be by you or any three or two of you administred on the holy Evangelist of almighty God in presents of the Complainant (or deft if any) touching the truth or remembrances of their knowledge or any thing that may Relate to the Cause aforesaid and that Reduceing the Severall depossions into writing you send ye same together with this Our Commission under your or any of y three or two of you hand Hands to us to Our County Court of Somerset with all Convenient Speed Wittness William Planner Gent.m One of Our Justices of Our County Court of Somerset the Seventeenth day of June in the Sixteenth Year of Our Dominion &.c anno Dom 1730 On the back Side of the foregoing Commission it was thus Endorsed vizt Memorand.m that this day to witt the 18th day of August 1730 before me John Handy one of his Lordships Justices of the peace for Somerset County Came John Purnall Esq.r and M.r William Lane and Was Sworn on the holy Evangelist of almighty God to Execute the within Commission according to an act of assembly for Examine Evidences in relation to the bounds of Land to the best of their knowledge John Handy Maryland Somerset County ss In pursuance of an act of assembly to examine Evidences in relation to the bounds of Land &.c And by vertue of a Commission Granted by the County Court to John purnall Wm Lane Robert Watson [illegible] or any three or two of them to examine evidences in Relation to the bounds of a Certain [illegible] the tenour and possession of Nehemiah Holland Called |
