40 having theire Account af.d against him to be barred ought not because they say that the said James hath not any Acct against the Said William Cornwallis for the Sum of Six pounds three Shillings which Accrued due to him the Said James since the promisse and assumption made in Manner and forme as the said Ja.s in his said plea hath alledged and this he prays may be Inquired of by the Countraye and the Deft in Like manner Thereupon command is given to the Sher of Somerset County that Immediately he Cause to come here twelve &.c by whom &c who neither &.c to recognize &.c because as well &.c of which Said preceipt the Said Sherr to witt John Purnall Gentm now hereat this day to witt the Seventeenth day of November anno Dom one thousand seven hundred & thirty comes and makes return that he hath here ready twelve &.c as by his Said preceipt he was Commanded and now hereafterwards to witt the Same day and Year Came the parties by their attorneys aforesaid and the Jurors of that Jury therein Impannelled being Called ^likewise^ Came to witt James Rownd, Samuel Dorman, Thomas Selby Isaac Piper, John Webb, John Hooffington, Solomon Colebourn, John Shockley, Peter Claywell, Francis Porter Bruffe Broughton, Hugh Nelson who being due elected tryed and Sworn to say the truth in the premises upon their Oath do Say that the afd James Shirley did not assume upon himselfe in manner and form as the aforesaid Rebecca and John above against him have Complained &c Therefore it is Considered that the aforesaid Rebecca and John Executors of the afd William Cornwallis Take nothing by their Writt and declaration afd but be thereof in mercy for their falce Clamour and that the afd James Shirley Goe thereof without day &c
for the Said Joshua Ward that in Case he be nonsuited in the plea afd or otherwise Legally Cast that then ye Said Joshua Ward Shall pay the Condemnation of the Court and all Costs accrewing thereon to the Said Henry Williams or that he ye Said Thomas Billings will do the same for him &c
Purnall of the County aforesaid in relation to the bounds of a tract of Land lying in the County aforesaid Called Sherbourne we therefore Require you or any three or two of you at Some time and place as ^to^ you or any three or two of you shall Seem Convenient you meet on the aforesaid Land Called Sherbourn (you first having taken your Oath on the holy Evangelist of Almighty God according to act of assembly in Such Case made & provided) and there Cause to Come before you or any three or two of you all Such evidences as shall be to your or any three or two of you nominated by the Said Complainant (or defend.t if any) and that your examine them upon their Corporall Oaths to be by you or any three or two of you to be administred on the holy Evangelist of Almighty God in the presence of the Complainant (or defend.t if any) touching the truth or remembrances of their knowledge or any thing that may Relate to the Cause afd and that reduceing the Severall depossitions into writing you Send the Same together with this Our Commission under Your or any three or two of Your hands to us to Our County Court of Somerset with all Convenient Speed Wittness William Planner Gent.m One of Our Justices of our Said Court the Seventeenth day of June in the Sixteenth Year |
