On the back side of the foregoing account it was thus Endorsed vizt Maryland ss July 4.th 1730 Then came the within named Robert Gordon before me the subscriber One of his Lordships Justices of the provinciall Court and made Oath on the holy Evangelist of Almighty God that the within acco.t is Just and true and that he (to the best of his Knowledge) hath not directly or indirectly received any part ^or parcell^ thereof or any Security or Satisfaction for the Same Sworn to before me Benj.a Tasker A Copy of the foregoeing declaration and account were made and Sent to be Served on the defend.t in Custody as aforesaid Att which said next Court to witt the seventeenth day of November anno Dom One thousand seven hundred and thirty Came againe as well the aforesaid Robert Gordon by his attorney aforesaid as the said James Rowland in his proper person in Custody as aforesaid and thereupon the sher of Somerset County to witt John Purnall Gent ^and [illegible] to ye pt yt he^ had delivered to the aforesaid James Rowland in Custody as aforesaid the afd Copy of the aforesaid declaration & account afd according to Law in Such Case made and provided thereupon the aforesaid Robert Gordon by his attorney aforesaid prays that the aforesaid James Rowland in Custody as aforesaid to his declaration aforesaid may Answer whereupon ^and^ the aforesaid James Rowland in Custody as aforesaid hath day untill the third day of this term to him given by the Court here to answer &.c And the Same James Rowland in Custody as aforesaid at the same day ^being^ Solemnly called Cometh not but nor says nothing in barr or preclusion of the action aforesaid of the aforesaid Robert Gordon by which the same Robert remaineth against the aforesaid James Rowland in custody as aforesaid thereof undefended &.c Wherefore the aforesaid Robert his damages by Occasion of the non performance of the promise & assumption aforesaid against the aforesaid James Ought to Recover &.c Whereupon At the prayer of the aforesaid Robert and by the Consent of the Same Robert the Justices here according to act of assembly in Such Case made and provided assessed the damages of the Same Robert by Occasion of the nonperformnce of the promise and assumption aforesaid beyound his Costs and charges by ^him^ that part about his Suit in that part apposed to seventeen pounds twelve Shillings and five pence Currant mony &c Therefore it is Considered that the aforesaid Robert Gordon Recover against the aforesaid James Rowland in Custody as aforesaid seventeen pounds twelve Shillings and five pence Currant mony his damages afd by the Justices aforesaid in form aforesaid assessed as also four hundred & twenty four pounds of tobacco for his Costs and Charges to the Same Robert of his assent by the Court here adjudged & the aforesaid James in Mercy &c And afterwards [illegible] [illegible] Cometh herein^to^ Court the afd James Rowland in Custody as aforesaid in his proper person and thereupon the said James Rowland at the prayer of the afd Robert Gordon ^his attry afd^ is Committed into ye Custody of the Sher of Somerset County thereto remain untill ye said Robert Gordon of his damages & Costs afd should be fully satisfied thereupon the afd sher to witt Jno Purnall Gent being present ^herein Court^ took Charge of ye Said James Rowland accordingly &c |
