of trespass upon the Case &c And whereupon the said Robert by Francis Allen his attorney Complaines that whereas the Said Somerset in his Lifetime to witt the thirtieth day of October Seventeen hundred and twenty Six at Somerset County aforesaid within the Jurisdiction of this Court was Indebted unto the Said Archibald Smith in his Lifetime in Six pounds four Shillings and Seven pence Currant mony of maryland as by account hereunto annexed may appear and being so thereof Indebted the Said Somerset in his Lifetime in Consideration thereof the day and Year aforesaid as the place aforesaid upon himselfe did assume and to the Said Archibald in his LIfetime then and there did faithfully promise that he the Said Somerset the said Six pounds four Shillings and Seven pence to the Said Archibald when he Should be thereunto requested he would well and faithfully pay and Content and altho' the Said Somerset in his Lifetime three pounds fourteen Shillings and three pence halfe penny parcell of the aforesaid Six pounds four Shillings and ^Seven^ Six pence to the Said Archibald in his life time he hath paid and Satisfied Yett as to two pounds teen Shillings and three pence halfe penny residue thereof the said Somrset in his Life time and the said Hannah since ye Decease of the Said Somrsett the Promise and Assumption of the Said Sumrset in forme af.d made nothing regarding but plotting and fraudulently Intending and Each of them plotting and fraudulent Intending the Said Archibald in Life time & the Said Rob.t in his Said Capacity Since the Decease of the said Archibald in that part Craftilly and Subtilly to Deceive and Defraud the said two pounds tenn Shillings and three pence half peny to the Said Archibald Smith in his Life time or to the af.d Rob.t in his Said Capacity Since the Decease of the said Archibald have not paid or Contented nor Either of them hath paid or Contented Altho the Same to do the Said Somrset in his Life time to witt on the Eight day of Nov.r seventeen hundred and twenty Eight and often afterwards by the said Archibald in His Life time and the said Hannah Since the Decease of the Said Somrset to witt on the first day of May Seventeen hundred and thirty and often afterwards by the Said Rob.t in his Said Capacity they were thereunto at the County af.d Within the Jur afd requested but the Same to pay have refused and the Said Hannah the Same to the Said Rob.t in his Capacity af.d to pay still doth refuse and Deny to the damage of the S.d Rob.t of five pounds money af.d And thereupon he Brings Suite and brings into Co.t here his Lett.rs of Admrcon by w.r &.c F Allen P Qrte Pleg p 8 Jn.o Doe & R Roe
Then Came into court M.r Robert Smith administrator of Archibald Smith during the minority of James Smith &.c according to act of assembly in Such Case made and provided &.c Thomas Hayward Cl And the aforesaid Hannah Dickerson in her Own proper person Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle here untill the next Court and she hath and the same day is Given to the aforesaid plft here also &c Att which said Next Court to witt Eighteenth day of August Ann.o Dom One thousand Seven hundred and thirty Came againe as well the afd Robert by his attorney ^afd^ as the aforesaid Hannah Dickerson in her proper person and whereupon the same Robert Hannah prays further Leave thereof to Imparle here untill the next |
