unto Robert Gordon of a plea of trespass upon the case &c and that thereof he should not fail &c

             Att which Said third tuesday of June to witt the sixteenth day of June the same month ^ann.o Dom one thousand seven hundred & thirty^ being the day of the return
of the Said Writt Cometh the said Robert Gordon by francis Allen his attorney and the Sherr of Somerset County to whom the
foregoeing writt was directed Likewise Comes and makes Return thereof to the Court here Endorsed vizt

    Thereupon the said James Rowland in his own proper person appears and thereupon the said James Rowland
at the prayer of the plfts attorney aforesaid is adjudged to Give Speciall bail to the action aforesaid but for
want thereof the Said James Rowland is Committed into the Custody of the Sher of Somerset County thereto remain &.c
the Said Sher to witt John Purnall Gent.m ^present here in Court^ took Charge of the Said James Rowland accordingly    thereupon day is
Given to the said James Rowland in Custody as afd ^here^ untill next Court & ye Same day is Given to ye plft here also &c

Att which Said next Court to witt the Eighteenth day of August anno Dom one thousand seven hundred and thirty Came againe
as well the aforesaid Robert Gordon by his attorney aforesaid as the aforesaid James Rowland in his proper person in
Custody as ^afd^ and thereupon ^further^ day is Given ^to^ the afd James Rowland in Custody as aforesaid untill the next Court and ye Same
day is Given to the afd plft here also   And whereupon the Said Robert Gordon by his attorney afd declared against the
Said James Rowland in Custody as aforesaid in the plea aforesaid vizt as followeth vizt

Somerset ss   James Rowland Late of Somerset County planter was attached to answer unto Robert Gordon of a plea
of trespass upon the Case &.c
                                              And whereupon the Said Rob.t by francis Allen his attorney Complaines that Whereas
the Said James the twenty second day of June Ann.o Dom seventeen hundred and twenty Nine at Somrset County af.d
within the Jurisdiction of the Cout was Indebted unto the said Rob.t in the Sum of Seven pounds twelve Shillings &
five pence Currt Money of Maryland as by account here unto annexed and herein Co.t produced may appear
And being so thereof Indebted the Said James in Consideration thereof the day and year af.d at the County af.d upon hismelfe
did Assume and to the Said Rob.t then and there faithfully did promise that he the Said James the Said Seventeen
pounds twelve Shillings and five pence Currt Money to the Said Rob.t when thereunto afterward he should be requested
he wold well and faithfully pay and Content  Nevertheless the af.d James his promise and assumption af.d in form
af.d made nothing Regarding but plotting and fraudulent Intending the Said Rob.t in that part Craftily and Subtilly to
deceive and defraud the Said Seventeen pounds twelve shillings and five pence to the Said Rob.t altho the same to do
the Said James on the af.d twenty second day of June in the Year af.d and often afterwards at the County af.d by the said
Rob.t he was thereunto requested hath not paid or to him for the Same in Any wise Contented but the Same to him
hitherto to pay or in any sort to Content hath refused and still doth refuse and deny whereupon he saith he is
worse and hath damage to the value of thirty five pounds four Shillings and tenn pence Like money and thereupon
