34 Joseph MccClayland as of the rights and Creditts of the aforesaid John Gordon may be condemned in the hands of the said Joseph MccClayland towards Satisfying of the said Thomas Gordon the sum of forty two pounds Eighteen shillings seven pence and One thousand pounds of tob.o Thereupon the afd Joseph MccClayland altho' Solemnly Called cometh not but makes default now Shews Cause why &c Whereupon a Certain James Mackmorie of Somerset County Gentm present here in Court undertakes for the Said Thomas Gordon according to act of assembly in that case made and provided That in Case the said John Gordon shall at any time within a year and a day appear and make all or any part ^of^ the said six pounds so as aforesaid attached appeared to be Satisfied or Otherwise to have been undue before the Laying of this attachment that then the Said Thomas Gordon shall make restitution unto him the Said John Gordon of all or such part thereof as shall be made appear to be undue &.c or that the Said James Mackmorie will do it for him Therefore it is Considered by the Court here that the aforesaid Sum of six pounds Curr.t mony so as afd attached may be Condemned in the hands of the aforesaid Joseph MccClayland as of the Rights and Creditts of the aforesaid John Gordon towards Satisfying of the Said Thos Gordon the afd Sum of forty two pounds Eighteen Shillings and Seven pence and One thousand pounds of tobacco and that the afd Thomas Gordon have thereof his execution against the said John Gordon according to act of Assembly &c
Eighteenth day of March Ann.o Dom Seventeen hundred and twenty Eight at Somrset County within the Jur of this Court by his Certain WRiting Obligatory Granted him self to be held and firmly bound to the same John In the sum of three thousand three hundred and sixty pounds of Pork to be paid the same John when afterwards he Should be thereto required yet the af.d John Baker tho' often thereto required the af.d sum of three thousand three hundred and sixty pounds of pork nor any Part thereof to the Same John Donelson hath rendred or him for it In Any Wise Contented but the same John Baker the same Hitherto to render Hath denyed and still doth deny and Unjustly detain to the dams of the same John six thousand pounds of pork and thereof he brings this Suit &.c And he brings hereinto Court the Writing Obligatory &c John Donelson pse Jno Do R Roe And the aforesaid John Baker by Levin Gale his attorney comes and defends the force and Injury when &.c and says that he Cannot Gainsay the action aforesaid of the aforesaid John Donnelson nor can he say but that the writing obligatory aforesaid is the deed of the same John Baker nor but that he owes the same John Donelson the aforesaid three thousand three hundred and sixty pounds of pork in manner and form as the aforesaid John Donelson above against him hath declared thereupon the said John Donelson prays Judgm.t for his debt aforesaid and his damages by occasion of the detaining of the same debt to him to be adjudged &c Therefore it is Considered that the aforesaid John Donelson Recovered against the aforesaid the aforesaid John Baker his debt afd and his damages by occasion of the detaining of the same debt to 291 pounds of tobacco to the same John Donelson of his assent by the Court here adjudged and the aforesaid John Baker in mercy &c
