33 John Gordon for the aforesaid Sum of forty two pounds Eighteen Shillings and Seven pence &.c according the form of the act of Assembly in that Case made and provided and for so doing this Shall be Your warrent Given Under my hand & Seal this 20.th day of October ann.o Dom 1730 James Dashiell (Seal) To Mr Thomas Hayward Cl Somerset County
In pursuance to an Act of Assembly of this province now in force and in Obedience to the aforesaid Warrent the following attachment was Issued ^against^ the Goods and Chattells rights and Creditts of the aforesaid John Gordon the tenour whereof followeth in these words viz.t Somerset ss Charles absolute Lord and Proprietary of the provinces of maryland and Avalon Lord Baron of Baltemore &.c To the Sher of Somerset County Greeting we Command you that you Attach any the Goods Chattles rights or Creditts of John Gordon late of Somrset County Pla^n^ter if they Shall be found in your Bailywick to the Value of forty two pounds Eighteen shillings and Seven Pence Curr.t money and one thosand pounds of Tobacco And when you have the Same so Attached or any part thereof ye Same in your Custody safe keep so that you have the Same before the Justices of Our County C.t to be held at Dividing Creek the third tuesday of Novem.r Nextto then and there to be Condemned According to Act of Assembly to and for the use of a Certain Thom.s Gordon unless the Said John Gordon by himselfe or his Attorney Shall Appear and Answer unto the Said Thomas Gordon in a plea of trespass upon the Case &.c According to Law and that by Good and Lawfull men of your Bailywick you make known unto the person or persons in whose hands you make the Same Attachment that he She or they be and Apear before the Justices of Our County Co.t to be held as af.d to Shew Cause if any he She or they have why the Same Goods Chattles rights or Creditts so Attached in his her or theire hands ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in Such Case made and provided if to him her or them it Shall Seem mete and how you Shall Execute this Writt that you make known unto our said Justices at the day & place af.d and have you then and there this Writt Wittness Sam.l Hopkins Gent.m Cheif Justices of Our Said Co.t the 22 day of August in the 16.th Year of Our Dominion &.c Ann.o Dom 1730 Att which said third tuesday of November to witt the Seventeenth day of the Same month Anno Dom One thousand Seven hundred and thirty being the day of the return of the Said Writt Cometh the afd Thomas Gordon by Levin Gale his attorney and the Sherrife of Somerset County to whom the foregoeing writt was directed Comes and makes return thereof to the Court here Endorsed viz.t Attached in the Hands of Joseph MccClayland Six pounds Curr.t mony before John Doe & Richard Roe P John Purnall sher And the Said Thomas Gordon by Levin Gale his attorney Comes herein Court and prays that upon giving Security according to act of assembly that the aforesaid Sum of Six pounds Curr.t mony so as aforesaid Attached in the hands of the afd Joseph |
